El presente volumen pretende analizar, a través de cuatro trabajos concretos, el cambio de paradigma que la revolución tecnológica ésta provocando en el proceso. Se abordan así, por un lado, dos temas que si bien traen causa de realidades extraprocesales de gran relevancia jurídica, dejan sentir su efecto en el proceso planteando cambios y reflexiones de profundo calado: uno, el valor probatorio que puede alcanzar la información digital obtenida por el empresario (audios, videos, correos electrónicos...) en el ejercicio de su potestad de control sobre el trabajador; y otro, el impacto que van a generar en el proceso los nuevos mecanismos de protocolos computerizados de transacción y de registro basados en tecnología blockchain. Pero la irrupción tecnológica afecta también a la propia Administración de Justicia. Y, en ese sentido, dos estudios de los contenidos en el presente volumen profundizarán, por un lado en el uso (y la protección) de los datos personales en el seno del proceso; y, por otro, en la exclusión que origina la brecha digital en el acceso a la Justicia por parte de determinados colectivos ciudadanos: singularmente quienes afectados por condiciones económicas desfavorables (pobreza) y por razones edad (personas mayores) van a tener un nulo o muy limitado acceso y/o manejo de las nuevas realidades tecnológicas. Conscientes de esta realidad, en el presente libro se compendian once estudios en los que sus autores reflexionan sobre los efectos que la pandemia que padecemos provoca en el funcionamiento de nuestro sistema de justicia; en la oportunidad que se abre ante este reto y las posibilidades que ofrecen la nuevas tecnologías para afrontarlo debidamente; en la eventualidad de que estas puedan favorecer el uso de medios de resolución de conflictos distintos al proceso; en las ventajas e inconvenientes que suscita la llamada prueba digital o electrónica; en el uso de la denominada justicia predictiva o inteligencia artificial en el proceso civil; en la realización judicial de los bienes a través del portal de subastas del BOE; o en el acta digital, entre otras destacadas cuestiones. Las consideraciones que se hacen en estos trabajos permiten concluir que la crisis causada por el COVID-19 no solo nos ha dado la oportunidad de acelerar el ritmo de implantación de las nuevas tecnologías. Nos ha señalado también la necesidad de afrontar importantes cambios en nuestra Administración de Justicia y de repensar algunos de los axiomas sobre los que se asienta, sin que ello suponga al propio tiempo merma o sacrificio de los derechos que se tienen reconocidos.
