O presente livro foi idealizado pela turma do Doutorado em Direito da Pontifícia Universidade Católica de São Paulo-PUC/SP, em cumprimento ao crédito “Ordenamento Jurídico e Sistema”. Matéria, esta, sob minha titularidade, na qualidade de Professor. Finalizamos o segundo semestre do ano de 2017, com horizontes majorados. A proposta do livro corrobora como prova dessa realidade discursiva. Trata-se de uma turma bem especial. Reconheço que um convívio sadio foi alcançado. Afinal, competentes e dedicados profissionais do Direito, então estudiosos de diversas áreas de pesquisa, empreenderam esforços para qualificar os estudos realizados na matéria, então sob a minha regência, nos respectivos âmbitos de suas pesquisas. Com certeza a pluralidade de fontes, então somada à diversidade de bases investigativas, enriqueceu ainda mais o discurso acadêmico, com novos diálogos públicos, na estrutura comunicacional, conforme ora se apresenta. Tal realidade potencializa novos olhares aos campos teorético e pragmático do instrumental jurídico. Portanto, é uma honra receber a missão de apresentar a novel obra. A turma é composta por advogados, juízes, procuradores e outros profissionais que atuam nas representações de governos e/ou de estado. De igual forma, muitos deles também atuam na qualidade de professores, em Universidades (Públicas e Privadas), nacionalmente reconhecidas. O objetivo da obra está centrado no Constructivismo Lógico-Semântico, este, pois, inserto na Filosofia da Linguagem. A proposta temática, comumente por mim defendida, tem alicerce em longos anos de trabalhos acadêmicos, todos estes, dedicados à cientificidade almejada ao âmbito do Direito. São diversas as argumentações enfocadas na presente obra. Todas elas oportunizam a majoração dos ângulos de análise da proposta discursiva, esta, pois, baseada na cultura da linguagem e seu âmbito de avaliação. Isso enriquece a relação de multidisciplinariedade que norteia os campos específicos de cada proposta, assim articulada. Os autores são Amini Haddad Campos, Aurélio Joaquim da Silva, Bruno Augusto Sampaio Fuga, Daniel Brajal Veiga, Diogo Basilio Vailatti, Douglas Anderson Dal Monte, Erick Macedo, Flávio Crocce Caetano, Guillermo Glassman, Luis Claudio Ferreira Cantanhêde, Marcelo Romão Marineli, Marlon Wander Machado, Paulo Henrique Guilman Tanizawa, Silvio Marques Garcia e Smith Barreni. Todos estão de parabéns pelas projeções das discussões acadêmicas, então produzidas durante o segundo semestre de 2017. A obra, que honrosamente apresento, é a demonstração fiel da realidade complexa que assegura uma múltipla gama de discussões, então vivenciadas nos seminários do Doutorado, junto à Pontifícia Universidade Católica. Eis a prova, então externada na produção que se efetiva. Destaco também especial agradecimento aos Professores Fabiana Del Padre Tomé, Lucas Galvão de Britto, Aurora Tomazini e Robson Maia Lins, pois todos foram de fundamental importância para as discussões acadêmicas, bem como para as aulas e seminários ministrados durante este período. Em especial, destaco e parabenizo Fabiana Del Padre Tomé, por também contribuir, nesta publicação, com o capítulo denominado “Teoria da Prova e o Processo: Análise pela Perspectiva do Constructivismo Lógico-Semântico”; ao Robson Maia Lins, com especial agradecimento pela sua incansável ação na colaboração e na organização do presente livro. De igual forma, ressalto a sua desmedida contribuição nas discussões de alto nível, então promovidas junto à turma de Doutorado da PUC/SP. O livro cumpre seu propósito de atender à pesquisa de um único tema central: O Constructivismo Lógico-Semântico. Espero que a obra seja mais um norte à compreensão da importância da linguagem diante da necessária delimitação fática da realidade, esta, pois, a ser posteriormente catalogada pelo Direito, em seu campo e limite de interesse. 'This is an outline of a coherence theory of law. Its basic ideas are: reasonable support and weighing of reasons. All the rest is commentary.’ These words at the beginning of the preface of this book perfectly indicate what On Law and Reason is about. It is a theory about the nature of the law which emphasises the role of reason in the law and which refuses to limit the role of reason to the application of deductive logic. In 1989, when the first edition of On Law and Reason appeared, this book was ground breaking for several reasons. It provided a rationalistic theory of the law in the language of analytic philosophy and based on a thorough understanding of the results, including technical ones, of analytic philosophy. That was not an obvious combination at the time of the book’s first appearance and still is not. The result is an analytical rigor that is usually associated with positivist theories of the law, combined with a philosophical position that is not natural law in a strict sense, but which shares with it the emphasis on the role of reason in determining what the law is. If only for this rare combination, On Law and Reason still deserves careful study. On Law and Reason also foreshadowed and influenced a development in the field of Legal Logic that would take place in the nineties of the 20th century, namely the development of non-monotonic (‘defeasible’) logics for the analysis of legal reasoning. In the new Introduction to this second edition, this aspect is explored in some more detail.
