Las disfunciones del sistema democrático y del actual modelo constitucional han derivado en una oleada de reformas legales y medidas políticas, tendentes a restaurar la confianza ciudadana y la credibilidad social en las instituciones. Ante la impresión generalizada de una democracia aparentemente floral, con excesivos fallos sistémicos y multiorgánicos, se plantea necesariamente un revisionismo constitucional y el desarrollo de controles jurídicos para neutralizar los abusos y extralimitaciones desde los poderes públicos. Bajo un panorama insostenible de escándalos y corrupción política, la necesidad actual de juridificar la democracia como muro de contención de sus propias patologías, revela paralelamente la baja calidad del sistema democrático español . Las lagunas jurídicas y constitucionales sobre transparencia, conflicto de intereses y un régimen oclusivo de la participación ciudadana han actuado como detonantes de una aparente toxicidad sistémica. Sin que se haya evolucionado hacia los nuevos parámetros de calidad democrática, desde el compromiso con los derechos fundamentales a la asunción de estándares internacionales de transparencia o responsabilidad social pública. Los agujeros negros de la Constitución y la trastienda de la democracia han potenciado el desarrollo de una política tentacular colonizadora de las instituciones, en una atmósfera de connivencia legal y constitucional (Joan Ridao). Por esta razón, el informe sobre el Sistema de Integridad Nacional de España, denominado “Marco de Integridad Institucional en España: situación actual y recomendaciones”, alerta sobre un excesivo riesgo de politización del sistema que necesariamente debe ser minimizado. El proceso de control jurídico como antídoto frente al “imperio de la política” se ha iniciado mediante la adopción de medidas redemocratizadoras y reformas legales con un impacto constitucional . La regulación de derechos emergentes de información pública, participación ciudadana y la incipiente asunción legal de un modelo de responsabilidad social pública, presentan una dimensión constitucional . En los siguientes epígrafes se verifica un análisis de las últimas tendencias legales para la reactivación del sistema democrático, cuestionando la constitucionalidad de algunas disposiciones reformistas.

This is the English version of Jerzy Wroblewski's major work in Polish, S~dowe Stosowania Prawa (translated in his own preferred terms as 'The Judicial Application of Law'). The present translation arose out of a visit by the author to Scotland in 1989. In that year, the Carnegie Trust for the Universities of Scotland made it possible for Jerzy Wroblewski to spend six months as a Carnegie Fellow in the Centre for Criminology and the Social and Philosophical Study of Law at the University of Edinburgh. During that time he took a notably active part in the intellectual life of the Centre and the Faculty of Law. He gave freely of his time in teaching and advising students and also produced a series of original articles on topics connected with legal reasoning and law and computers. His major task while he was here, however, was to prepare a translation of S~dowe Stosowania Prawa, and this he accomplished to the extent of completing a preliminary draft. Zenon Bankowski and Neil MacCormick were to help him in improving this linguistically and preparing the final text for publication. Wroblewski warned us, having finished his draft with great labour, that the greater labour would be in the polishing of it. For we would have, as he joked, 'to translate my English into English'. And certainly, we found it extremely time-consuming, so as to defy completion during his stay in Edinburgh.

This powerfully argued appraisal of judicial review may change the face of American law. Written for layman and scholar alike, the book addresses one of the most important issues facing Americans today: within what guidelines shall the Supreme Court apply the strictures of the Constitution to the complexities of modern life? Until now legal experts have proposed two basic approaches to the Constitution. The first, “interpretivism,” maintains that we should stick as closely as possible to what is explicit in the document itself. The second, predominant in recent academic theorizing, argues that the courts should be guided by what they see as the fundamental values of American society. John Hart Ely demonstrates that both of these approaches are inherently incomplete and inadequate. Democracy and Distrust sets forth a new and persuasive basis for determining the role of the Supreme Court today. Ely’s proposal is centered on the view that the Court should devote itself to assuring majority governance while protecting minority rights. “The Constitution,” he writes, “has proceeded from the sensible assumption that an effective majority will not unreasonably threaten its own rights, and has sought to assure that such a majority not systematically treat others less well than it treats itself. It has done so by structuring decision processes at all levels in an attempt to ensure, first, that everyone’s interests will be represented when decisions are made, and second, that the application of those decisions will not be manipulated so as to reintroduce in practice the sort of discrimination that is impermissible in theory.” Thus, Ely’s emphasis is on the procedural side of due process, on the preservation of governmental structure rather than on the recognition of elusive social values. At the same time, his approach is free of interpretivism’s rigidity because it is fully responsive to the changing wishes of a popular majority. Consequently, his book will have a profound impact on legal opinion at all levels—from experts in constitutional law, to lawyers with general practices, to concerned citizens watching the bewildering changes in American law.
