El autor identifica como origen de esta grave situación a la hegemonía que por más de quinientos años han ejercido las escuelas del derechonatural y del positivismo jurídico sobre las mentalidades de los civilistas. Pro-pone entonces efectuar una relectura de los conceptos fundamentales del derecho civil en los términos del realismo jurídico.
