"Como bien lo resume R. Entrena Cuesta, la literatura jurídico-administrativa de todos los tiempos y países se ha ocupado con singular frecuencia de los contratos celebrados por la Administración pública como técnica jurídica. Ello obedece, sin duda, al carácter central de dicho instituto en la teoría general del Derecho administrativo. Hasta el punto de que puede afirmarse, no existe mejor piedra de toque para averiguar en qué medida un Ordenamiento jurídico está dominado por los principios que informan el régimen administrativo, que la de examinar la regulación que nos ofrece de los referidos contratos públicos. En definitiva, el tema de los contratos públicos ha sido, es y será un elemento capital de la función administrativa y como tal ha pasado a ser también, una de las instituciones básicas, esenciales o fundamentales del Derecho administrativo contemporáneo. De ahí que los contratos públicos sean un tema inacabable del Derecho público (G. Ariño Ortiz), si bien de «sustancia polémica» (E. García de Enterría), «difícil de asir» (G. Lieux-Veaux) o, en fin, uno de los capítulos más «desesperantes» del Derecho administrativo (A.R. Brewer-Carías). En conclusión, la gestión pública contractual no es ajena al régimen de Derecho administrativo, de la función de la Administración pública, ni tiene formas jurídicas de manifestación distintas de aquélla; por el contrario, el régimen y las formas jurídicas de la función administrativa son aplicables integralmente a la gestión pública contractual, por una elemental razón lógica de especificidad, lo cual hace del contrato público uno de los temas medulares del Derecho administrativo. Así las cosas, en el medio jurídico contemporáneo, el reconocimiento general de gestión pública contractual, resulta básico encontrar las ideas-rectoras de los sistemas de la contratación pública, el origen, el fundamento y el régimen jurídico en general, lo cual constituye objeto de esta nueva obra, a través del estudio integral de la teoría general del contrato público."
