A proposta do presente trabalho é investigar a relevância das provas para a constituição do fato jurídico tributário, sob o âmbito da imposição tributária. Empreenderemos o exame acerca do relevante papel que as provas desempenham nas relações entre o Estado e os contribuintes, através dos atos de lançamento, para a caracterização do fato jurídico tributário e, consequentemente, à constituição do crédito tributário. O foco da abordagem que pretendemos realizar é demonstrar que a prova se perfaz de extrema importância no contexto da percussão tributária, de modo que pretendemos destacar a sua imprescindibilidade para a sustentação das normas individuais e concretas por parte da Administração Pública, e, logo, do ato administrativo de lançamento tributário, a partir de elementos colhidos em procedimentos fiscalizatórios. Ainda, temos o intuito de demonstrar a importância das provas na percussão tributária, demonstrando a importância de que os fatos jurídicos tributários sejam constituídos somente se embasados em provas admitidas em direito, em sede de processo administrativo fiscal, com o intuito de preservar os direitos e as garantias fundamentais dos contribuintes. Pretendemos, assim, realizar um estudo acerca do fato jurídico tributário e das provas, e, em especial, no processo administrativo tributário, mediante a demonstração da legislação pertinente, bem como de jurisprudência administrativa e exemplos práticos.

A insegurança jurídica daqueles que operam com os ativos virtuais (criptoativos) se dá desde a forma genérica com que a Receita Federal tributa, pelo imposto sobre a renda, as diferentes operações com os ativos virtuais – ignorando que cada operação tem fatos geradores e efeitos tributários diversos – até os golpes praticados por intermédio de investimentos em ativos virtuais como as pirâmides financeiras. A partir do ideal de liberdade e observado o dever fundamental de pagar tributos, é possível ultrapassar a discussão sobre a licitude do planejamento tributário – que também pode ser ilícito – por intermédio dos ativos virtuais, já que a legalidade desses ativos já havia sido reconhecida pelo Estado brasileiro antes mesmo da regulação desse mercado pela Lei no 14.478, de 21 de dezembro de 2022. Ao pesquisar leis e normas, julgados do STF, STJ e do CARF, materiais bibliográficos e artigos científicos sobre direito tributário, planejamento tributário e sobre os ativos virtuais e sites de internet especializados nesses ativos, foi possível identificar como garantir a segurança jurídica das pessoas físicas que operam com os ativos virtuais, sobretudo em questões fisco/tributárias, como em que momento se dá o fato gerador e qual o montante a compor a base de cálculo do imposto sobre a renda já consideradas eventuais deduções no caso do ganho de capital. Ao fim, analisando-se legislações sobre os ativos virtuais pelo mundo, concluiu-se como o Brasil pode dar segurança jurídica ao setor.
