Uno de los males endémicos de la justicia administrativa es la excesiva dilación en la resolución de los procedimientos en todas las instancias. Ni los sucesivos esfuerzos por dotar de mejores medios personales y técnicos a nuestra organización judicial, ni la progresiva introducción de los medios alternativos de resolución extrajudiciales, han logrado mitigarlo de manera apreciable. Muestra de ello es que el campo de aplicación de la reciente Ley 5/2012, de 6 de julio, de mediación, se ha restringido a los asuntos civiles y mercantiles. Hay, sin embargo, una tercera vía para atajar sus efectos perniciosos, vía que permanece inexplorada en gran medida a día de hoy. Se trata de la terminación anormal o anticipada del proceso, cuyo tratamiento en las primeras leyes decimonónicas de la Jurisdicción contencioso-administrativa y, especialmente, en la Ley de 1956, fue novedoso y tuvo no poca influencia en la regulación del proceso de los otros órdenes jurisdiccionales. El presente libro aborda, en un lenguaje claro, las luces y las no pocas sombras del estancamiento e insuficiencia de su regulación actual, adaptada a las leyes de agilización procesal, de economía sostenible y a la ya citada de mediación, apoyándose en un exhaustivo examen de su vertiente jurisprudencial. Desde tal análisis propone la resolución de las contradicciones que la atenazan y las medidas de reforma que pueden, de verdad, contribuir a su plena eficacia, en aras de un proceso más ágil y adecuado a las pretensiones de las partes.
