When Archbishop Henry O’Leary became the second archbishop of Edmonton in 1920, he had a dream to build a western Canada Catholic college that would educate students in the Christian intellectual tradition.This is the story of how a small Roman Catholic institution confronted daunting challenges to become a Christian beacon of enlightenment at the very heart of the secular University of Alberta. Scholarship and community life in residence was always supplemented with teaching from the Christian Ministry Team, to form Christian citizens who would go out into the world to serve the larger community following graduation. In 1963, the Congregation of St. Basil took over the administration of the College from the Christian Brothers de la Salle who had administered the College from its founding in 1926. Since its establishment almost ninety years ago, the College has continued to provide young men and women with post-secondary courses grounded in Roman Catholic thought while pursuing their undergraduate degrees at the University of Alberta. Initially, a residence was built for men, but O’Leary’s dream of also constructing a women’s residence never died and was finally realized in 2015. Faced with slender means, misunderstandings, student mischief and personality clashes, the mission of St. Joseph’s College has guided faculty, administrators, staff and Board members throughout its history and melded them into a close-knit community whose example is the envy of other units at the University of Alberta.

On 15 August 1990 the Vatican issued Pope John Paul's Apostolic constitution Ex corde Ecclesiae (From the Heart of the Church) concerning Catholic higher education. Promulgated as law, the document deal firstly with the Catholic identity and mission of the college or university, and secondly with the general norms for all institutes of higher studies. The document also reflects and reaffirms the mandatum of c. 812. This study looks at the mandatum and how the norms of Ex corde Ecclesiae are implemented at a Catholic college in the United States that is sponsored by a religious institute by attempting to place the discussion in the context of the American culture. Beginning with a canonical look at the defining moment when one becomes a Catholic and an historical examination of the university system and the Catholic Church, this study shows the intimate relation that religious institutes have had with higher education. In the United States there are over 230 Catholic colleges and universities and other such institutions of higher studies, most of which are canonically and civilly connected to a religious institute. The question is what role does the sponsoring religious institute have in the canonical compliance of their separately incorporated apostolate in the implementation of the norms of Ex corde Ecclesiae? Discussed in this work are the canonical obligations and rights of the diocesan bishop, the religious institute, the college (administrators and trustees) and the professors of theological disciplines. This study also looks at some of the issues of concern that were raised by theologians, canonists, colleges and universities, religious institutes and bishops relating to the implementation of Ex corde Ecclesiae. It took ten years for the bishops of the United States to receive the Vatican recognitio for "The Application of Ex corde Ecclesiae for the United States" to be used in the implementation of Ex corde Ecclesiae for American Catholic colleges and universities. On 3 May 2001 the Application became particular law for the United States. St. Norbert College, a Norbertine sponsored college in De Pere, Wisconsin, USA, is used as the case study for this work.

In the Apostolic Constitution, Ex corde Ecclesiae, John Paul II states that the Catholic university and college is a human institution wherein the members critically assist in the on-going promotion of human dignity and cultural heritage through the three-fold missions of teaching, researching, and providing various pastoral services. Moreover, the members perform these tasks, imbued with the Christian spirit and inspired with the Gospel values in order to "assure in an institutional manner a Christian presence in the university world confronting the great problems of society and culture." In short, the institution marks the confluence of two streams within a Catholic academic environment--culture and religion. Church legislation has remained neither silent nor irrelevant on the question of Catholic higher education. In fact, the 1983 Code of Canon Law devotes several canons of related issues pertinent to these institutions. It does not, however, systematically address the critical topic of church-related educational institutions with respect to religiously-owned universities and colleges and their canonical status. Instead, in a more general way, the 1983 Code introduces new and broader options for canonical status, including the public and private juridic person and the public and private associations of the faithful with or without juridic personality. Consequently, at the heart of this dissertation lies the issue of canonical status of religiously-owned federated Catholic universities and colleges in Canada; the crux of the matter is the precise determination of and alteration to that canonical status, given the broader designations in the 1983 Code. Accordingly, based on the presumption that tracing the titles to property of religiously-owned educational institutions is the truest indicator of its present canonical status, this dissertation undertakes a canonical investigation into the titles to property of the Basilian-owned, Canadian federated Assumption University at Windsor, Ontario. Selecting and properly applying an option, if appropriate, presents innovative ways to direct various educational institutions within particular settings and under different governance models, while ensuring, among other concerns, the protection against exposure to civil and canonical liabilities of church-related institutions and the on-going mission of the Catholic university.
