The general topic of this book is the theory of categories, its sources, meaning and development. The inquiry can be seen to proceed on two levels. On one, the history of the theory is traced from its alleged genesis in Aristotle, through its main subsequent stages of Kant and Hegel, up to a kind of consummation in two of its prominent twentieth century adherents, Alfred North White head and Nicolai Hartmann. Special attention has been paid to that aspect of the Hegelian conception of the categorial analysis from which the principle of coherence emerged. On the second, deeper level, however, everything starts with Whitehead's metaphysical system, the central part of which con sists of a fascinating, though highly intricate, web of categorial notions and propositions. The historical perspective becomes a means for untangling that web. I am indebted to a number of people for advice, comment and criticism of various parts of this book. My greatest thanks go to my teachers and colleagues Nathan Rotenstreich, Nathan Spiegel, Yaakov Fleischman, as well as to the late Shmuel Hugo Bergman and Pepita Haezrachi. of this book was published in 1967 by An earlier, Hebrew version the Bialik Institute of Jerusalem. I am grateful to Mr Yehoshua Perel, Mr Arnold Schwartz and to my wife Varda for their cooperation in rendering the extensively revised text of the book into readable English. I also owe great appreciation to Miss Liat Dawe for an accurate and painstaking word-processing of the text.

Place Of Performance written by Chukwuma Okoli and has been published by Bloomsbury Publishing this book supported file pdf, txt, epub, kindle and other format this book has been release on 2020-05-28 with Law categories.

This book provides an unprecedented analysis on the place of performance. The central theme is that the place of performance is of considerable significance as a connecting factor in international commercial contracts. This book challenges and questions the approach of the European legislator for not explicitly giving special significance to the place of performance in determining the applicable law in the absence of choice for commercial contracts. It also contains, inter alia, an analogy to matters of foreign country mandatory rules, and the coherence between jurisdiction and choice of law. It concludes by proposing a revised Article 4 of Rome I Regulation, which could be used as an international solution by legislators, judges, arbitrators and other stakeholders who wish to reform their choice of law rules.

Developments In Eu External Relations Law written by Marise Cremona and has been published by OUP Oxford this book supported file pdf, txt, epub, kindle and other format this book has been release on 2008-09-25 with Law categories.

External relations is currently among the most dynamic areas of EU law, its institutional structures profoundly affected by the Lisbon Treaty. This volume gathers leading analysts to assess core recent developments in the field, taking stock of the current law and potential developments in major policy areas. The volume opens with an assessment of a central concept at the heart of EU external relations, underpinning its international identity. Christophe Hillion analyses the legal principles which ensure coherence between different strands of the EU's external activity, and the contribution of law to the consistency of the EU's international presence. Frank Hoffmeister turns the focus outwards to the interaction between the EU and the international legal order - the legal basis for the EU's activity in shaping international law and the EU's contribution to 'state practice'. These opening chapters develop a picture of the EU's active international participation as well as the characteristic structural complexity of its external relations, and against this background the remainder of the book examines key policy areas of EU external action. Lorand Bartels analyses the relationship between trade policy and development; Markus Krajewski discusses trade in services and the link between external and internal policy issues; and Nathalie Tocci assesses the EU's contribution to conflict resolution, an important focus of the Common Foreign and Security Policy. The complex policy picture that emerges from the different goals, values and instruments across these areas is examined in the book's final chapter which focuses on the European Neighbourhood Policy, frequently proclaimed as a strategic priority for the EU. Together, the essays present a clear picture of the complex development of EU external relations, of the struggle for coherence in the increasingly active, visible and self-conscious role played by the EU as a participant in the international legal order.

Structural Principles In Eu External Relations Law written by Marise Cremona and has been published by Bloomsbury Publishing this book supported file pdf, txt, epub, kindle and other format this book has been release on 2018-02-22 with Law categories.

The law and practice of EU external relations is governed not only by general objectives (Articles 3(5) and 21 TEU and Article 205 TFEU) and values (Article 2 TEU) but also by a set of principles found in the Treaties and developed by the Court of Justice, which structure the system, functioning and exercise of EU external competences. This book identifies a set of 'structural principles' as a legal norm-category governing EU external relations; it explores the scope, content and function of those principles that may be categorised as structural. With an ambitious scope, and a stellar line-up of experts in the field, the collection offers a truly innovative perspective on the role of law in EU external relations.

There is one question that any potential reader who suspects that Alfred North Whitehead (1861-1947) might be important for past, contemporary, and future philosophy inevitably raises: how should I read Whitehead? How can I make sense of this incredibly dense tissue of imaginative systematizing, spread over decades of work in disciplines so different and specialized as algebra, geometry, logic, relativistic physics and philosophy of science? Accordingly, this monograph has two main complementary objectives. The first one is to propose a set of efficient hermeneutical tools to get the reader started. These straightforward tools provide answers that are highly coherent and probably the most applicable to Whitehead's entire corpus. The second objective is to illustrate how the several parts of Process and Reality are interconnected, something that all commentators have either failed to recognise or only incompletely acknowledged.

Perspective In Whitehead S Metaphysics written by Stephen David Ross and has been published by SUNY Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 1983-01-01 with Philosophy categories.

Stephen David Ross presents an extensive, detailed, and critical interpretation of Whitehead's mature thought, emphasizing the fundamental role of perspective in Whitehead's cosmology, and tracing the conflicts and difficulties therein to tensions involving perspective in relation to other central features of Whitehead's thought. Ross isolates four principles as having a fundamental role in whitehead's metaphysics: perspective, cosmology, experience, and mechanical analysis. He argues that many of Whitehead's difficulties can be eliminated by raising the principle of perspective to prominence and by revising the other central features of Whitehead's theory accordingly. This book addresses key Whiteheadian texts and secondary interpretations of Whitehead. The discussion ranges over most of Whitehead's theory in Process and Reality, and offers a number of significant and, in some cases, novel views on different aspects of Whitehead's theory: perception, prehension, causation, objective immortality, self-causation, the extensive continuum, natural order, possiblity, concreteness, and God. Ross's concluding suggestions for modifying Whitehead's system promise to occasion much debate among process philosophers, theologians, and anyone concerned with Whitehead's thought.
