The purpose of the Code of Conduct is to assist Members of Parliament in the discharge of their obligations to the House of Commons, their constituents and the public at large by: (a) providing guidance on the standards of conduct expected of Members in discharging their parliamentary and public duties, and in so doing (b) providing the openness and accountability necessary to reinforce public confidence in the way in which Members perform those duties. Members are expected to observe the general principles of conduct identified by the Committee on Standards in Public Life: selflessness; integrity; objectivity; accountability; openness; honesty; leadership. The Guide to the rules relating to the conduct of Members assists members in discharging the duties placed upon them by the Code of Conduct. It covers : registration of Members' financial interests; declaration of members' interests; lobbying for reward or consideration; and procedure for complaints.

The purpose of this Guide is to assist Members in discharging the duties placed upon them by the Code of Conduct agreed by the House. It replaces the Guide approved by the House on 14 May 2002 (HC 841 (2001-02)). While previous editions of the Rules derived their authority from Resolutions of the House rather than from statute or common law, the attention of Members is drawn to the fact that in respect of registration categories 4, 5, and 6, there are in addition requirements imposed by the Political Parties, Elections and Referendums Act 2000 (PPERA) as amended by the Electoral Administration Act 2006. The Guide is divided into four sections dealing with: (1) Registration of interests; (2) Declaration of interests; (3) Lobbying for reward or consideration; (4) Procedure for complaints.

The Code of Conduct provides a set of rules to which Members must adhere. Some of these rules are supported by more detailed guidance. Those set out in this Guide relate to the registration and declaration of interests, and to paid lobbying. The Guide also sets out the procedure for inquiries by the Parliamentary Commissioner for Standards. The Guide to the Rules and amendments to it are approved by means of Resolutions of the House of Commons. This Guide therefore carries the authority of the House. The House has agreed that its previous resolutions in relation to the conduct of Members shall be read and given effect in a way which is compatible with the Code of Conduct and this Guide to the Rules relating to the conduct of Members. The Guide is structured as follows: (1) Chapter 1 of the Guide explains the requirements in relation to the registration of Members' financial interests; (2) Chapter 2 explains the requirements in relation to the declaration of interests in proceedings of the House and on other occasions; (3) Chapter 3 sets out the restrictions on Members engaging in lobbying for reward or consideration; (4) Chapter 4 provides an outline of the Commissioner's remit, and sets out the procedures in relation to the Commissioner's inquiries.

This report considers a complaint made against Alison Seabeck, teh Member for Plymouth, Moor View, that she failed to declare an indirect interest in the Fire Protection Association when she took aprt in the debate in the House on the Second Reading of the Fire Safety (Protection of Tenants) Bill on 19 November 2010. Ms Seabeck's partner, Nick Raynsford, Member for Greenwich and Woolwich, had registered financial interest as a non-executive board member of the fire Protection Association and as chair of its Advisory Council. He had also registered financial interests as honorary vice-chairman of theconstruction Industry Council and as chairman of the National House-Building Council (NHBC) Foundation. A complaint was made that over a five-year period the Member for Leyton and Wanstead, Harry Cohen, had claimed more than £100,000 against the Additional Costs Allowance (ACA) for his designated second home in his constituency, having identified as his main home a house in Colchester, Essex. It was also pointed out that there were entries by Mr Cohen in the Register of Members' Financial Interests to the effect that he owned and in one year received rental income from a property in Colchester. The Parliamentary Commissioner for Standards investigated (his report appears as an appendix in this document). Mrs Cohen's ill-health meant that from April 2004 their constituency home became their main home, and the Commissioner finds that Mr Cohen was in breach of the rules in identifying Colchester as the main home. The Committee agrees with the Commissioner that Mr Cohen should have continued to register the rental income from his Colchester house, following the initial registration in 2001 and notes he has now complied with registration requirements. The Committee also agrees that Mr Cohen was in serious breach of the rules in claiming Parliamentary allowances against the constituency property which was in effect the main home. Mr Cohen should apologise with a personal statement on the floor of the House and the full amount of resettlement grant (£65,000) which would be payable when he leaves the House (at the end of this Parliament) should be withheld.
