How did the drastic experiences of the turbulent twentieth century affect the works of a legal historian? What kind of an impact did they have on the ideas of justice and rule of law prominent in legal historiography? Ville Erkkila analyses the way in which the concepts of 'Rechtsgewissen' and 'Rechtsbewusstsein' evolved over time in the works of the prestigious legal historian Franz Wieacker. With the help of previously unavailable sources such as private correspondence, the author reveals how Franz Wieacker's personal experiences intertwined in his legal historiography with the tradition of legal science as well as the social and political destinies of twentieth century Germany.

When legal scholars or judges approach the subject of sexuality, they are often constrained by existing theoretical frameworks. For instance, queer theorists typically focus on sexual liberty but tend not to consider issues such as sexual violence. Feminist theories focus on violence but often don’t give recognition to the joy of sexuality. To assess the possibility of devising a legal theory of sexuality that can ensure equality without assimilation, diversity without exclusion, and liberty without suffering, Elaine Craig examines the Supreme Court of Canada’s approach to sexuality in cases that range from sexual violence to discrimination based on orientation. Although the Court continues to hold an essentialist understanding of sexuality that renders certain harms invisible, its feminist-inspired approach to sexual violence recognizes the socially constructed nature of sexuality and produces legal reasoning that promotes sexual integrity as a common interest. Blending feminist theory with the inclusiveness of queer theory, Craig advances an iconoclastic approach to law and sexuality that has the power to transform both theory and practice.

Convictions of Conscience: How Voices From the Margins Inform Public Actions and Educational Leadership seeks to help educational leaders to develop the competencies and capacities required to create socially just and equitable schools. It is for educational leaders interested in transforming systems and decolonizing education rooted socially, structurally and ideologically in hegemony. This edited volume promotes the questioning of assumptions embedded in neoliberal new managerialism practices that often undergird the preparation and training of school leaders. New managerialism in higher education seeks to understand the market forces in order to cater to the idiosyncratic, often self-promoting needs and interests of the few and seeks to respond with programs and policies aligned with those forces and interest. This volume suggests that the confluence of context, theory and pedagogical strategies within the field of educational leadership should inform curricular decisions in educational leadership preparation programs and such programs should be designed to prepare school leaders as both activists and advocates for marginalized students, parents, communities, and staff. Convictions of Conscience is a call on educational leaders who are committed to success for all students to reject new managerial approaches at all levels of educational leadership and is an invitation to expand their emphasis to concerns rooted in human context, particularly identity politics. Towards this end a decolonizing philosophically grounded practice of educational leadership that disrupts static relations within the structures of power is required to move toward a more socially just praxis. The chapter authors seek to problematize understandings of diversity and inclusion by emphasizing the integral role of equity and social justice as critical dimensions of human relationships. Additionally chapter authors intentionally interrogate the socio-cultural dimensions that affect educational leaders.

American Catholic Bishops And The Politics Of Scandal written by Meaghan O'Keefe and has been published by Routledge this book supported file pdf, txt, epub, kindle and other format this book has been release on 2019-04-18 with Religion categories.
This book explores the rhetoric and public communication of the Catholic Church in the United States in the wake of the sexual abuse scandals and offers a demonstration of how large organizations negotiate a loss of public trust while retaining political power. While the Catholic Church remains a major political force in the United States, recent scandals have undoubtedly had an adverse effect on both its reputation and moral authority. This has been exacerbated by the public responses of Catholic clergy, which have often left supporters of the Church, let alone critics, profoundly unsatisfied. Drawing on documents – voting guides, pastoral letters, sermons, press releases, and other materials – issued by the United States Conference of Catholic Bishops (USCCB) as well as American nuns, the book explores Catholic political statements issued after the sexual abuse crises entered the public consciousness. Using approaches from linguistics and rhetoric, it analyses how these statements compare to similar materials issued before this time. This comparison demonstrates that for the American Catholic Church persuasion is less important than maintaining the impression that there has been no loss of authority. This is a timely study of the Catholic Church’s handling of the recent revelations of abuse within the Church. As such, it will be of keen interest to scholars of religious rhetoric, contemporary Catholicism, linguistics, rhetoric, communication, and religious studies.
