American college campuses, where ideas are freely exchanged, contested, and above all uncensored, are historical hotbeds of political and social turmoil. In the past decade alone, the media has carefully tracked the controversy surrounding the speech of Iranian President Mahmoud Ahmadinejad at Columbia, the massacres at Virginia Tech, the dismissal of Harvard’s President Lawrence Summers, and the lacrosse team rape case at Duke, among others. No matter what the event, the conflicts that arise on our campuses can be viewed in terms of constitutional principles, which either control or influence outcomes of these events. In turn, constitutional principles are frequently shaped and forged by campus culture, creating a symbiotic relationship in which constitutional values influence the nature of universities, which themselves influence the nature of our constitutional values. In The Constitution Goes to College, Rodney A. Smolla—a former dean and current university president who is an expert on the First Amendment—deftly uses the American university as a lens through which to view the Constitution in action. Drawing on landmark cases and conflicts played out on college campuses, Smolla demonstrates how five key constitutional ideas—the living Constitution, the division between public and private spheres, the distinction between rights and privileges, ordered liberty, and equality—are not only fiercely contested on college campuses, but also dominate the shape and identity of American university life. Ultimately, Smolla compellingly demonstrates that the American college community, like the Constitution, is orderly and hierarchical yet intellectually free and open, a microcosm where these constitutional dichotomies play out with heightened intensity.

Those educations ranged from outlawed Irish “hedge schools” to England’s venerable Inns of Court, from the grammar schools of New England to ambitious new academies springing up on the Carolina frontier. The more traditional schools that focused on Greek and Latin classics (Oxford, Harvard, Yale, William and Mary) were deeply conservative institutions resistant to change. But the Scottish colleges and the newer American schools (Princeton, Philadelphia, King's College) introduced students to a Scottish Enlightenment curriculum that fostered more radical, forward-thinking leaders. Half of the Framers had no college education and were often self-taught or had private tutors; most were quiet at the convention, although a few stubbornly opposed the new ideas they were hearing. Nearly all the delegates who took the lead at the convention had been educated at the newer, innovative colleges, but of the seven who rejected the new Constitution, three had gone to the older traditional schools, while three others had not gone to college at all. Schools for Statesmen is an unprecedented analysis of the sharply divergent educations of the Framers of the Constitution. It reveals the ways in which the Constitutional Convention, rather than being a counterrevolution by conservative elites, was dominated by forward-thinking innovators who had benefited from the educational revolution beginning in the mid-eighteenth century. Andrew Browning offers a new and persuasive explanation of key disagreements among the Framers and the process by which they were able to break through the impasse that threatened the convention; he provides a fresh understanding of the importance of education in what has been called the "Critical Period" of US history. He who can change the Constitution controls the Constitution. So who does control the Constitution? The answer has always been: “the people.” The people control the Constitution via the Article V amending process outlined in the Constitution itself. Changes can only be made through Article V and its formal procedures. Article V has always provided a means of perfecting the Constitution in an explicit, democratically authentic, prudent, and deliberative manner. In addition to changing the Constitution Article V also allowed the people to perfect and preserve their Constitution at the same time. In recent years Article V has come under attack by influential legal scholars who criticize it for being too difficult, undemocratic, and too formal. Such scholars advocate for ignoring Article V in favor of elite adaptation of the Constitution or popular amendment through national referendums. In making their case, critics also assume that Article V is an unimportant and expendable part of the Constitutional structure. One notable scholar called the Constitution “imbecilic” because of Article V. This book shows that, to the contrary, Article V is a unique and powerful extension of the American tradition of written constitutionalism. It was a logical extension of American constitutional development and it was a powerful tool used by the Federalists to argue for ratification of the new Constitution. Since then it has served as a means of “perfecting” the US Constitution for over 200 years via a wide range of amendments. Contrary to contemporary critics, the historical evidence shows Article V to be a vital element in the Constitutional architecture, not an expendable or ancillary piece. This book defends Article V against critics by showing that it is neither too difficult, undemocratic, nor too formal. Furthermore, a positive case is made that Article V remains the most clear and powerful way to register the sovereign desires of the American public with regard to alterations of their fundamental law. In the end, Article V is an essential bulwark to maintaining a written Constitution that secures the rights of the people against both elites and themselves.
