Protecting designs is complex and diverse; it involves deciding whether to protect them by design law, copyright law, or by both laws. A single protection may be under- or overprotective but two or more can be overprotective if there are no rules regulating the overlap. Legal systems in Europe and abroad have struggled to find the most adequate solution to this problem. This book traces the history of the design/copyright interface of fifteen countries, selected for their diversity in the way they dealt with the interface. It examines how these countries have coped with the problems engendered by the interface, the rules they applied to it over time and the reasons for legislative changes. This analysis reveals the most appropriate rules to regulate the interface at EU and global level and will appeal to academics, practising lawyers, judges, students and policymakers all over the world.

This chapter examines the history of the copyright/design interface in Italy from the first copyright and design Acts of the Italian state to the implementation of the Design Directive in 2001. The country has known two main periods, one of full cumulation and the second of partial cumulation. In this second period, partial cumulation was based mainly on separability (scindibilità). From 2001 onwards, the criterion of artistic value took over that of separability. In the last part, the chapter analyses the successes and failures of this history and draws conclusions as to which period or system worked best, if any.

This paper attempts to determine the most adequate rules to regulate the interface between copyright and design protection. The main standard to determine such rules is avoiding both under- and over-protection. To achieve such balanced protection, criteria to regulate the interface used in several countries are evaluated. In addition, simplicity and efficiency of the system for both designers and users are also important criteria taken into consideration. The paper starts by giving a historical account of the efforts made both at international and EU level to regulate the interface. It then compares the experiences of the countries reviewed in the book over the years to discover similarities, differences and trends. In the following section, the paper assesses the adequacy of the possible models and criteria to organise the interface and proposes a model copyright/design interface.

This article examines the interface in copyright and design law in Denmark and with accounts also for Norway and Sweden. It is pointed out how Scandinavian courts have historically employed several strategies to limit copyright protection of works of applied art including:1) “raising the bar” to keep works with “clear functional intentions” out of copyright (as seen in Norway and until recently also in Sweden) and, 2) narrowing the scope of protection (seen in all three nations). It is finally pointed out how, presently, it is doubtful to what extent the development in EU law will allow these models developed in national law to continue.
