One of the most intriguing, and disturbing, aspects of history is that most people in early modern Europe believed in the reality and dangers of witchcraft. Most historians have described the witchcraft phenomenon as one of tremendous violence. In France, dozens of books, pamphets and tracts, depicting witchcraft as the most horrible of crimes, were published and widely distributed. Yet, in his new book, The Crime of Crimes: Demonology and Politics in France, 1560-1620, Jonathan Pearl shows that France carried out relatively few executions for witchcraft. Through careful research he shows that a zealous Catholic faction identified the Protestant rebels as traitors and heretics in league with the devil and clamoured for the political and legal establishment to exterminate these enemies of humanity. But the courts were dominated by moderate Catholics whose political views were in sharp contrast to those of the zealots and, as a result, the demonologists failed to ignite a major witch-craze in France. The judicial administration of France had its origin in the Feudal System. The great nobles ruled their estates side by side with, and not under, the King. With him the great barons exercised ÒhighÓ justice, extending to life and limb. The seigneurs and great clerics dispensed ÒmiddleÓ justice and imposed certain corporal penalties, while the power of ÒlowÓ justice, extending only to the amende and imprisonment, was wielded by smaller jurisdictions. The whole history of France is summed up in the persistent effort of the King to establish an absolute monarchy, and three centuries were passed in a struggle between nobles, parliaments and the eventually supreme ruler. Each jurisdiction was supported by various methods of enforcing its authority: All, however, had their prisons, which served many purposes. The prison was first of all a place of detention and durance where people deemed dangerous might be kept out of the way of doing harm and law-breakers could be called to account for their misdeeds. Accused persons were in it held safely until they could be arraigned before the tribunals, and after conviction by legal process were sentenced to the various penalties in force. The prison was de facto the high road to the scaffold on which the condemned suffered the extreme penalty by one or another of the forms of capital punishment, and death was dealt out indifferently by decapitation, the noose, the stake or the wheel. Too often where proof was weak or wanting, torture was called in to assist in extorting confession of guilt, and again, the same hideous practice was applied to the convicted, either to aggravate their pains or to compel the betrayal of suspected confederates and accomplices. The prison reflected every phase of passing criminality and was the constant home of wrong-doers of all categories, heinous and venial. Offenders against the common law met their just retribution. Many thousands were committed for sins political and non-criminal, the victims of an arbitrary monarch and his high-handed, irresponsible ministers. The prison was the KingÕs castle, his stronghold for the coercion and safe-keeping of all who conspired against his person or threatened his peace. It was a social reformatory in which he disciplined the dissolute and the wastrel, the loose-livers of both sexes, who were thus obliged to run straight and kept out of mischief by the stringent curtailment of their liberty. The prison, last of all, played into the hands of the rich against the poor, active champion of the commercial code, taking the side of creditors by holding all debtors fast until they could satisfy the legal, and at times illegal demands made upon them.

If, as was said, she had engaged in vile Satanic rituals and had sought to poison a rival for the King's affections, what was Louis XIV to do? The Royal Financial Administration and the Prosecution of Crime in France, 1670–1789 explores the French monarchy’s role in financing criminal prosecutions in the royal courts of the realm—the payment of criminal frais de justice in the vocabulary of the ancien régime—between 1670 and 1789 (that is, from the codification of criminal judicial procedure in the early period of Louis XIV’s personal rule to the outbreak of the French Revolution). The subject brings together three areas of scholarly inquiry—criminal justice, royal administration, and the management of the crown’s finances. A central goal of the study is to provide factual information and interpretive insights on each of these topics and to explain the relationship of each to the others over a long time period. The book contributes to existing scholarship in four ways. First, although each of the major dimensions of the inquiry—the operation of the criminal justice system, the conduct of the royal administration, and the management of the monarchy’s finances—has a large and increasingly sophisticated historical literature, this is the first study to combine them in a systematic way. Second, the long time period covered in the book not only enables the historian to distinguish gradual from rapid change, but it also allows the reader to view how the system functioned in different historical contexts. Third, the study is based on archival sources throughout France. This comprehensive approach permits the identification of elements of a common experience without sacrificing attention to important aspects of regional diversity. Finally, with respect to the sources themselves, the range is broad, encompassing regulatory acts and decisions of the king’s councils; administrative correspondence at the central, regional, and in some cases local levels; financial accounts and related papers; and court records from the major appellate courts and from several lower courts as well. An appendix of 33 tables lists figures of annual expenditure and other pertinent financial operations for each of the major financial districts of the kingdom.
