"This book is an account of the evolution of the jury and jury trial from early times to the present day including changes brought in by the Criminal Justice Act 2003 that widen the categories of people undertaking jury service." "The Criminal Jury Old and New traces the genesis of the historic system of 'trial by peers' from its roots as a replacement for trial by ordeal through all its great legal and political landmarks. It shows how the jury changed and developed across the centuries to become a key democratic institution capable of resisting monarchs, governments, pressure and interference - and, on occasion, the plain words of the law. It also looks at such intriguing concepts as 'jury nullification', 'perverse verdicts' and 'pious perjury'."--BOOK JACKET.

"I owe a great debt to the many jurors, judges, lawyers, trial consultants, historians, and academics around the world from whom I have had the pleasure of learning about the jury. Traci Emerson Spackey of the George Washington University Law Library provided extraordinarily creative and effective help in locating images and other sources. Clifford Ando gave valuable recommendations about sources for the ancient world, and Daniela Cammack kindly provided drafts of her now-published article about Athenian juries. Trial lawyer Bobby Burchfield generously gave detailed and deeply knowledgeable comments on the manuscript. Karen Wahl provided expert assistance locating sources. I thank Morgan Reinhardt for allowing me to use her research on jury forepersons, and Anna Offit, her law professor, for guiding me to her and for comparative work on juries. Anna Caraveli and Jonathan Chaves, my colleague at George Washington University, made important suggestions and pointed out places in which non-lawyers needed further explanation of legal concepts. My daughter Anna Lerner provided the perspective of a younger reader and gently let her mother know where improvements would be helpful. For decades, John Langbein has been a constant source of insight about juries. I am grateful to Akhil Amar for first sparking, and then encouraging, my interest in the subject, and for his vibrant work. My husband Craig Lerner gave unceasing encouragement and invaluable advice"--

Why do governments try to limit the application of jury trials, both in countries where jury trials are native and in countries that have more recently instituted them? This is a critical question today as government authorities are trying to limit the role of juries, especially when it comes to complex fraud cases, national security/terrorism cases, and cases where juries seem to have a propensity for high acquittal rates. Therefore, understanding how governments are promoting and constraining jury trials is important. This book analyzes the reasons that motivate governments to introduce jury trial practices and the factors that condition the role these types of trials play in the administration of criminal justice systems as a whole. The book's research derives its finding from the comparative analysis of criminal justice systems of the United Kingdom, the Russian Federation, and the Republic of Azerbaijan. It also assesses prospects of the application of jury trials in the Republic of Azerbaijan based on analysis of the criminal justice systems of countries where these practices already exist.

While much fundamental research in the recent past has been devoted to the criminal jury in England to 1800,there has been little work on the nineteenth century, and on the civil jury . This important study fills these obvious gaps in the literature. It also provides a re-assessment of standard issues such as jury lenity or equity, while raising questions about orthodoxies concerning the relationship of the jury to the development of laws of evidence. Moreover, re-assessment of the jury in nineteenth-century England rejects the thesis that juries were squeezed out by judges in favour of market principles. The book contributes a rounded picture of the jury as an institution, considering it in comparison to other modes of fact-finding, its development in both civil and criminal cases, and the significance, both practical and ideological, of its transplantation to North America and Scotland, while opening up new areas of investigation and research. Twelve Good Men And True written by J. S. Cockburn and has been published by Princeton University Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 2014-07-14 with Law categories.

Twelve Good Men and True brings together some of the most ambitious and innovative work yet undertaken on the history of an English legal institution. These eleven essays examine the composition of the criminal trial jury in England, the behavior of those who sat as jurors, and popular and official attitudes toward the institution of jury trial from its almost accidental emergence in the early thirteenth century until 1800. The essays have important implications for three problems central to the history of criminal justice administration in England: the way in which the medieval jury was informed and reached its verdict; the degree and form of independence enjoyed by juries during the early modern period when the powers of the bench were very great; and the role of the eighteenth-century trial jury, which, although clearly independent, was, by virtue of the status and experience of its members, arguably a mere extension of the bench. This extensive collection marks the first occasion on which scholars working in several different time periods have focused their attention on the history of a single legal institution. Written by J. M. Beattie, J. S. Cockburn, Thomas A. Green, Roger D. Groot, Douglas Hay, P.J.R. King, P. G. Lawson, Bernard William McLane, J. B. Post, Edward Powell, and Stephen K. Roberts, the essays utilize sophisticated techniques to establish from a variety of manuscript sources the wealth, status, and administrative experience of jurors. Originally published in 1988. The Princeton Legacy Library uses the latest print-on-demand technology to again make available previously out-of-print books from the distinguished backlist of Princeton University Press. These editions preserve the original texts of these important books while presenting them in durable paperback and hardcover editions. The goal of the Princeton Legacy Library is to vastly increase access to the rich scholarly heritage found in the thousands of books published by Princeton University Press since its founding in 1905.

Sir William Garrow was born in Middlesex, England in 1760. He entered the legal profession and became the dominant figure at Old Bailey - London's Central Criminal Court - from 1783 to 1793. Later on, he was a Member of Parliament, a Solicitor-General, an Attorney-General, and, finally, a judge and a lawmaker within the English Common Law Tradition. Aside from BBC1 TV's prime-time drama series Garrow's Law, the story of Sir William Garrow's unique contribution to the development of English law and Parliamentary affairs is little known by the general public. This book tells the real story of the man behind the drama. Garrow dared to challenge the entrenched legal ways and means. His 'gifts to the world' include altering the relationship between judge and jury (the former had until then dominated over the latter in criminal trials), helping to forge the presumption of innocence, rules of evidence, and ensuring a general right to put forward a defense using a trained lawyer.
