Legal socialization is the process by which children and adolescents acquire their law related values, attitudes, and reasoning capacities. Such values and attitudes, in particular legitimacy, underlie the ability and willingness to consent to laws and defer to legal authorities that make legitimacy based legal systems possible. By age eighteen a person's orientation toward law is largely established, yet legal scholarship has largely ignored this process in favor of studying adults and their relationship to the law. Why Children Follow Rules focuses upon legal socialization outlining what is known about the process across three related, but distinct, contexts: the family, the school, and the juvenile justice system. Throughout, Tom Tyler and Rick Trinkner emphasize the degree to which individuals develop their orientations toward law and legal authority upon values connected to responsibility and obligation as opposed to fear of punishment. They argue that authorities can act in ways that internalize legal values and promote supportive attitudes. In particular, consensual legal authority is linked to three issues: how authorities make decisions, how they treat people, and whether they recognize the boundaries of their authority. When individuals experience authority that is fair, respectful, and aware of the limits of power, they are more likely to consent and follow directives. Despite clear evidence showing the benefits of consensual authority, strong pressures and popular support for the exercise of authority based on dominance and force persist in America's families, schools, and within the juvenile justice system. As the currently low levels of public trust and confidence in the police, the courts, and the law undermine the effectiveness of our legal system, Tom Tyler and Rick Trinkner point to alternative way to foster the popular legitimacy of the law in an era of mistrust.

Inhaltsangabe:Zusammenfassung: Diese theoretische Arbeit beschäftigt sich mit Thema, inwieweit entwicklungspsychologische Forschungsbemühungen im Bereich der sogenannten „frühen Moral“ Aufklärung zu der Frage beitragen, ob Kinder in der Lage sind, moralische von konventionellen Normen zu unterscheiden bzw. sich diesen Unterscheidungen entsprechend zu verhalten. Ausgegangen wird dabei von den Arbeiten Lawrence Kohlbergs, der die These vertrat, jüngere Kinder (unter 10 Jahre alt) seien in ihrem sozialen Verhalten nahezu ausschließlich daran orientiert, Strafe zu vermeiden bzw. in egozentrischer Weise ihre Ziele zu verfolgen. Fähigkeiten zur Perspektivenübernahme seien nicht vorhanden; echtes moralisches Verhalten (nach Kohlberg die Orientierung des Handelns an Maßstäben der Gerechtigkeit) sei somit bei ihnen nicht möglich. Innerhalb verschiedener Forschungsansätze wurde diese Sicht der moralischen Kompetenz jüngerer Kinder in Frage gestellt. Es stellte sich heraus, dass Kinder unter bestimmten Bedingungen sehr wohl Entscheidungen treffen können, die sie mit Rückgriff auf moralische Normen begründen. Sie sind auch fähig, konventionelle von moralischen Normen zu unterscheiden, indem sie moralische Verhaltensregeln beispielsweise als weniger veränderbar betrachten als Konventionen. In meinem Überblick stelle ich die verschiedenen theoretischen und methodologischen Vorgehensweisen der Ansätze dar und arbeite heraus, welche Unterschiede in den Forschungsmethoden zu welchen Unterschieden in der Beurteilung der moralischen Entwicklung von Kindern führen. Dabei stellt sich unter anderem heraus, dass bestimmte Untersuchungsdesigns geradezu verhindern, dass Kinder innerhalb dieser Untersuchungen moralisches Verhalten zeigen können. Es ergibt sich ein durch die neueren Ansätze erweitertes und differenzierteres Bild in bezug auf die moralischen Fähigkeiten von Kindern, als das von Kohlberg propagierte. Wie ich aufzeige, bedeutet dies jedoch in keiner Weise, dass Kohlberg durch die neueren Ansätze „widerlegt“ wurde. Es wird vielmehr deutlich, dass Einseitigkeiten bzw. blinde Flecken in den Forschungsansätzen sowohl bei Kohlberg als auch bei seinen Kritikern zu den dargestellten unterschiedlichen Ergebnissen geführt haben, und dass es darum notwendig ist, die unterschiedlichen Ansätze zu integrieren. This is a book by pastor William Bacon that attempts to cover a wide range of issues that parents must confront in helping their children become responsible Christians. It takes the controversial position that corporeal punishment, although it should be avoided, must be used when children do not readily accept other forms of inducement to obey parental authority. Not everyone will agree with its premises, but it provides critical information on the justification for physical discipline. William Bacon believed in the concept of a household "absolute government"; the child must understand that ultimate law and justice rest with the parents, and refusal of requests by children cannot be tolerated. Bacon also believed in what we today would call behaviorism: that the human child, like other creatures, can only attain a productive life through guidance that is clear, steadfast, and goal-orientated. The natural tendency in man is to disobey, and if his tendencies are not checked, he will fall into moral ruin. Consequently, Bacon does not hesitate in condemning parents who are too lazy or too weak to adequately discipline their children. Discipline to him meant whatever it took to make children conform to their parents' requests. Although harsh treatment is distasteful, Bacon believes not only will this form of correction benefit society, but will also, according to his analysis of Biblical scripture, immeasurably help the child's soul.
