Australia is presently seeking to streamline its civil justice system. It is popular folklore that the Australian civil justice system is inaccessible to 'ordinary people' as it is expensive, slow and complex. The reasons for these alleged failings are attributed to various causes, such as arcane and inefficient judicial practices, money-hungry lawyers or, more fundamentally, to the very underpinnings of civil litigation - adversarialism. This volume confronts this folklore. It provides perspectives about civil justice from its major user and funding source (government) and the group of Australians who have used it the least and feel most alienated from the system (indigenous Australians). It explores the insights of those who work with adversarialism day in and day out (judges and lawyers) and reveals both defenders and strident advocates for change. Finally, it steps back and gives an outsider's view of Australian adversarialism from those with knowledge of a sister system in the United States.

Annotation Are jury verdicts in business trials influenced less by a corporation's negligence than by sympathy for the plaintiffs, prejudice against business, and a belief in the corporation's "deep pockets"? Many members of the public and corporate executives believe that this is so, and they feel that the jury's decision making presents serious problems for American business competitiveness and its justice system. This book -- the first to provide a systematic account of how juries make decisions in typical business cases -- shows that these assumptions are false or exaggerated.Drawing on interviews with civil jurors, experiments with mock jurors, and public opinion polling, Valerie P. Hans explores how jurors determine whether businesses should be held responsible for an injury. She finds that many civil jurors, rather than being overly sympathetic to plaintiffs who bring civil lawsuits, are actually hostile to them, that there are only occasional instances of anti-business prejudice, and that there is no evidence of the deep-pockets hypothesis. Hans concludes that jurors do treat businesses differently than individuals, but this is because the public has higher expectations of corporations and more rigorous standards for their conduct.

Nuestras pretensiones en esta investigación se centran en analizar las mediaciones laborales desde la perspectiva de la pragmalingüística, si bien es cierto que para delimitar el terreno propio de este género discursivo hacemos un estudio comparativo de los juicios, los arbitrajes, las conciliaciones y las mediaciones, en este último caso abordamos también las mediaciones educativas en contextos interculturales. Para llevar a cabo este análisis ofrecemos un capítulo introductorio donde tratamos el conflicto, así como una aclaración sobre los géneros extrajudiciales de resolución de conflictos, haciendo hincapié en las mediaciones. A continuación, ofrecemos un repaso diacrónico de estos géneros (anexo 1). Del mismo modo, aportamos un estado de la cuestión comentando algunos trabajos que se han realizado sobre este tema cuya base sea lingüística, en particular, o bien comunicativa, en general. En el apartado de fundamentación teórica incluimos la descripción del marco comunicativo, puesto que en los distintos géneros analizados nos encontramos con una estructura triádica, en lugar de los clásicos estudios binarios que habitualmente han sido descritos en las investigaciones sobre comunicación. The growing interest in civilizations, both on the level of political controversy ("the clash of civilizations") and in the context of scholarly debates, calls for more theoretical reflection on the problems and perspectives central to this field of social inquiry. This book contains the first systematical and critical survey of classical and contemporary approaches to comparative civilizational analysis; it goes on to outline a theoretical model that draws on the work of historical sociologists as well as on comparative cultural and intellectual history. Civilizations are analyzed as multi-dimensional formations, with particular emphasis on cultural orientations, but also on the autonomous dynamics of political and economic institutions.
