Disciplinary Measures from the Metrical Psalms to Milton studies the relationship between English poetry and church discipline in four carefully chosen bodies of poetry written between the Reformation and the death of John Milton. Its primary goal is to fill a gap in the field of Protestant poetics, which has never produced a study focused on the way in which poetry participates in and reflects on the post-Reformation English Church's attempts to govern conduct. Its secondary goal is to revise the understandings of discipline which social theorists and historians have offered, and which literary critics have largely accepted. It argues that knowledge of the early modern culture of discipline illuminates some important poetic traditions and some major English poets, and it shows that this poetry in turn throws light on verbal and affective aspects of the disciplinary process that prove difficult to access through other sources, challenging assumptions about the means of social control, the structures of authority, and the practical implications of doctrinal change. More specifically, Disciplinary Measures argues that while poetry can help us to understand the oppressive potential of church discipline, it can also help us to recover a more positive sense of discipline as a spiritual cure.

Foundations of Public Law offers an account of the formation of the discipline of public law with a view to identifying its essential character, explaining its particular modes of operation, and specifying its unique task. Building on the framework first outlined in The Idea of Public Law (OUP, 2003), the book conceives public law broadly as a type of law that comes into existence as a consequence of the secularization, rationalization and positivization of the medieval idea of fundamental law. Formed as a result of the changes that give birth to the modern state, public law establishes the authority and legitimacy of modern governmental ordering. Public law today is a universal phenomenon, but its origins are European. Part I of the book examines the conditions of its formation, showing how much the concept borrowed from the refined debates of medieval jurists. Part II then examines the nature of public law. Drawing on a line of juristic inquiry that developed from the late sixteenth to the early nineteenth centuries-extending from Bodin, Althusius, Lipsius, Grotius, Hobbes, Spinoza, Locke and Pufendorf to the later works of Montesquieu, Rousseau, Kant, Fichte, Smith and Hegel-it presents an account of public law as a special type of political reason. The remaining three Parts unpack the core elements of this concept: state, constitution, and government. By taking this broad approach to the subject, Professor Loughlin shows how, rather than being viewed as a limitation on power, law is better conceived as a means by which public power is generated. And by explaining the way that these core elements of state, constitution, and government were shaped respectively by the technological, bourgeois, and disciplinary revolutions of the sixteenth century through to the nineteenth century, he reveals a concept of public law of considerable ambiguity, complexity and resilience.

This book argues that a major part of the Chinese government’s road map, formulated in 2017, to modernise China comprehensively by 2049 is the process of social disciplining. It contends that the Chinese state sees that modernisation and modernity encompass not only economic and political–administrative change but are also related to the organisation of society in general and the disciplining of this society and its individuals to create people with “modernised” minds and behaviour; and that, moreover, the Chinese state is aspiring to a modernity with “Chinese characteristics”. The question of modernising by disciplining was extensively dealt with in the twentieth century by leading Western social scientists including Max Weber, Norbert Elias and Michel Foucault, who argued that disciplining, extending from external coercion towards the internalisation of restraints, is indispensable for achieving social order and thereby for “civilisation” –but defined from a European perspective, in relation to developments in Europe. This book therefore not only discusses the Chinese experience of social disciplining, but also, by looking at a non-Western society, identifies universal tendencies of societal change and social disciplining and separates them from particular occurrences.

This book uses extensive original archival and elite interview research to examine the attempt to rejuvenate liberalism as a means of disciplining democracy and the market through a new rule-based economic and political order. This rebirth took the form of conservative liberalism and, in its most developed form, Ordo-liberalism. It occurred against the historical background of the great transformational crisis of liberalism in the first part of the twentieth century. Conservative liberalism evolved as a cross-national phenomenon. It included such eminent and cultured liberal economists as James Buchanan, Frank Knight, Henry Simons, Ralph Hawtrey, Jacques Rueff, Luigi Einaudi, Walter Eucken, Friedrich Hayek, Alfred Müller-Armack, Wilhelm Röpke, Alexander Rüstow, and Paul van Zeeland, as well as leading lawyers like Louis Brandeis, Franz Böhm, and Maurice Hauriou. Conservative liberals also played a formative role in establishing new international networks, notably the Mont Pèlerin Society. The book investigates the rich intellectual inheritance of this variant of new liberalism from aristocratic liberalism, ethical philosophy, and religious thought. It also locates the social basis of conservative liberalism and Ordo-liberalism in the cultivated bourgeois intelligentsia. The book goes on to examine the attempts to embed this new disciplinary form of liberalism in Britain, France, Germany, Italy, and the United States, and to consider the determinants of its varying significance across space and over time.
