Human rights are inalienable and inviolable fundamental entitlements. The right of self-determination is one of such rights. It is the individual and collective right of the people, and especially of the indigenous peoples. Integrating indigenous knowledge systems is one of the tools to enforce the rights of self-determination to also ensure self-determined development. Starting from this perspective, this book presents the findings of a research work, which the author carried out on the actual enforcement of rights of self-determination and integration of indigenous knowledge systems of Gamo People of Ethiopia in light of the international legal instruments, policies of organizations of UN System such as International Fund for Agricultural Development (IFAD) and fundamental local laws and policy documents of Ethiopia. One of the aims of this study is to raise awareness on the indigenous knowledge systems and legal documents recognizing the rights of indigenous peoples. The author hopes that this study can add value to the development initiatives of Ethiopia and contribute its part to researchers, academic communities, policy makers, development partners and Gamo people.

Human rights organizations in Ethiopia have been devastated by the impact of legislation restricting their work. Many organizations have changed their focus, activities have been significantly scaled down, offices have closed and numerous staff have lost their jobs. The Charities and Societies Proclamation was passed in January 2009. It placed significant restrictions on funding for human rights work, granted the government excessive powers of interference in the running of organizations, jeopardized the security of victims of human rights violations, and allowed for the imprisonment of human rights defenders. The government has displayed hostility towards human rights defenders for many years through harassment, arrests and prosecutions, and has indicated that they do not see human rights work as a legitimate activity. The law has institutionalized this climate of fear. The majority of human rights defenders are now too afraid to speak out. The proclamation has adversely affected the promotion and protection of the rights of the Ethiopian people. Today there are almost no organizations holding the government to account for its human rights performance. This is one of three laws introduced since 2008 which restrict freedom of expression and people's ability to criticize their government. In this context the government continues to be responsible for widespread human rights violations, under ever-decreasing scrutiny. Amnesty International is urging the government of Ethiopia to amend the Charities and Societies Proclamation to remove the restrictions on human rights activities, and to recognize, respect and protect the vital work of human amnesty.org rights defenders.

This book presents a timely review of the relations between the formal and customary justice systems in Ethiopia, and offers recommendations for legal reform. The book provides cases studies from all the Region of Ethiopia based on field research on the working of customary dispute resolution (CDR) institutions, their mandates, compositions, procedures and processes. The cases studies also document considerable unofficial linkages with the state judicial system, and consider the advantages as well as the limitations of customary institutions with respect to national and international law. The editor's introduction reviews the history of state law and its relations with customary law, summarises the main findings by region as well as as on inter-ethnic issues, and draws conclusions about social and legal structures, principles of organization, cultural concepts and areas, and judicial processes. The introduction also addresses the questions of inclusion and exclusion on the basis of gerontocratic power, gender, age and marginalised status, and the gradual as well as remarkable recent transformations of CDR institutions. The editor's conclusion reviews the characteristics, advantages and limitations of CDR institutions. A strong case is made for greater recognition of customary systems and better alliance with state justice, while safeguarding individual and minority rights. The editors suggest that the current context of greater decentralization opens up opportunities for pratical collaboration between the systems by promoting legal pluralism and reform, thereby enhancing local level justice delivery. This book takes stock of political reform in Ethiopia and the transformation of Ethiopian society since the adoption of multi-party politics and ethnic federalism in 1991. Decentralization, attempted democratization via ethno-national representation, and partial economic liberalization have reconfigured Ethiopian society and state in the past two decades. Yet, as the contributors to this volume demonstrate, ‘democracy’ in Ethiopia has not changed the authority structures and the culture of centralist decision-making of the past. The political system is tightly engineered and controlled from top to bottom by the ruling Ethiopian Peoples’ Revolutionary Democratic Front (EPRDF). Navigating between its 1991 announcements to democratise the country and its aversion to power-sharing, the EPRDF has established a de facto one-party state that enjoys considerable international support. This ruling party has embarked upon a technocratic ‘developmental state’ trajectory ostensibly aimed at ‘depoliticizing’ national policy and delegitimizing alternative courses. The contributors analyze the dynamics of authoritarian state-building, political ethnicity, electoral politics and state-society relations that have marked the Ethiopian polity since the downfall of the socialist Derg regime. Chapters on ethnic federalism, 'revolutionary democracy', opposition parties, the press, the judiciary, state-religion, and state-foreign donor relations provide the most comprehensive and thought-provoking review of contemporary Ethiopian national politics to date.
