Is violent self-defense ethical? In the history of colonialism, racism, sexism, capitalism, there has long been a dividing line between bodies "worthy of defending" and those who have been disarmed and rendered defenseless. In 1685, for example, France's infamous "Code Noir" forbade slaves from carrying weapons, under penalty of the whip. In nineteenth-century Algeria, the colonial state outlawed the use of arms by Algerians, but granted French settlers the right to bear arms. Today, some lives are seen to be worth so little that Black teenagers can be shot in the back for appearing "threatening" while their killers are understood, by the state, to be justified. That those subject to the most violence have been forcibly made defenseless raises, for any movement of liberation, the question of using violence in the interest of self-defense. Here, philosopher Elsa Dorlin looks across the global history of the left - from slave revolts to the knitting women of the French Revolution and British suffragists' training in ju-jitsu, from the Warsaw Ghetto Uprising to the Black Panther Party, from queer neighborhood patrols to Black Lives Matter - to trace the politics, philosophy, and ethics of self defense. This book is a comprehensive philosophical study of the ethics of killing in cases in which the metaphysical and moral status of the individual killed is uncertain or controversial. Among the questionable and marginal in this way are human embryos, foetuses, neonates, animals, anencephalic infants, congenitally and cognitively-impaired human beings, and human beings who have become severely demented or irreversibly comatose. In an attempt to understand the question of moral status in such cases, The Ethics of Killing develops and defends many different accounts of personal identity, the nature of death, and the wrongness of killing. McMahan contends that the morality of killing is deeply complex and that the principles that determine the morality of killing in marginal cases are different from those that govern the killing of persons who are self-conscious and rational. Among the central claims of the book is that killing in marginal cases should be evaluated primarily in terms of the impact it would have on the victim at the time rather than on the ontological value of the victim's life as a whole. What primarily matters, in other words, is how killing the victim would affect what this particular victim is concerned with at the time of his or her death. In the second half of the book, the various foundational claims about identity, death, and killing are brought to bear in a systematic fashion to lead to conclusions that are both novel and plausible about such practical issues as abortion, prenatal injury, infanticide, the killing of animals, the significance of brain-death, the termination of life-support in cases of permanent vegetative state, the use of anencephalic infants as sources of organ- transplantation, euthanasia, assisted suicide, and advance directives in cases involving dementia. The right of self-defense is seemingly at odds with the general presupposition that killing is wrong; numerous theories have been put forth over the years that attempt to explain how self-defense is consistent with such a presupposition. In Justified Killing: The Paradox of Self-Defense, Whitley Kaufman argues that none of the leading theories adequately explains why it is permissible even to kill an innocent attacker in self-defense, given the basic moral prohibition against killing the innocent. Kaufman suggests that such an explanation can be found in the traditional Doctrine of Double Effect, according to which self-defense is justified because the intention of the defender is to protect himself rather than harm the attacker. Given this morally legitimate intention, self-defense is permissible against both culpable and innocent aggressors, so long as the force used is both necessary and proportionate. When is it morally permissible to engage in self-defense or the defense of others? Jonathan Quong defends a variety of novel ideas in this book about the morality of defensive force, providing an original philosophical account of the central moral principles that should regulate its use. We cannot understand the morality of defensive force, he reasons, until we ask and answer deeper questions about how the use of defensive force fits with a more general account of justice and moral rights. In developing this stance, Quong presents new views on liability, proportionality, and necessity. He argues that self-defense can sometimes be justified on the basis of an agent-relative prerogative to give greater weight to one's own life and interests, contrary to the dominant view in the literature. Additionally Quong develops a novel conception of individual rights against harm. Unlike some, who believe that our rights against harm are fact-relative, he argues that our rights against being harmed by others must, in certain respects, be sensitive to the evidence that others can reasonably be expected to possess. The book concludes with Quong's extended defense of the means principle, a principle that prohibits harmfully using other persons' bodies or other rightful property unless those persons are duty bound to permit this use or have otherwise waived their claims against such use.
