The EU Regulation on a Single Market for Digital Services (Digital Services Act, the 'DSA') is a comprehensive legal framework to regulate digital services and to tackle illegal activity online across the European Union. The DSA represents one of the main pillars of the EU's reform of the digital single market. It applies horizontally to online intermediaries operating in the EU, including online platforms such as social media, video-sharing platforms, online marketplaces, and search engines. The European Commission (EC) put forward two proposals, the DSA and the DMA, to improve the governance of digital services and markets in the European Union (EU). The proposals aim to create a safe environment for consumers when using digital services and to foster innovation and competition by creating a level playing field in digital markets. This workshop was organised to explore possible conclusions and recommendations on the DSA and DMA proposals and gather evidence on the expected effects of the regulation of online intermediaries. The aim of the first panel was to explore in more depth some of the issues covered by the DSA proposal, namely the fragmentation of the single market for services, the responsibilities of intermediaries and problems faced by consumers when using online platforms and digital services or accessing illegal services or products, as well as issues related to supervision and enforcement. The aim of the second panel was to explore some of the issues covered by the DMA proposal, namely the role that a few online platforms play in the digital economy and the need to ensure a fair and contestable online platform environment to the benefit of consumers.

The current legal framework for online content dissemination has proven insufficient to effectively combat illegal content. The Commissions' proposal for an EU 'Digital Services Act' aims to update the horizontal framework for intermediaries and create a safe online environment. However, as far as content mediation is concerned, European fundamental rights and values require that the specificities of media law must be taken into account. This study, conducted by the Institute of European Media Law (EMR) on behalf of the Media Authority of NRW, describes the current legal framework and the DSA proposal, and provides a comprehensive assessment from the perspective of media law, complemented by alternative proposals for further improvement.

According to the European Commission, two recent policies: the Digital Service Act and the Digital Market Act will allow for the regulation of a significant part of the EU Digital Single Market (DSM), to an extent similar to the creation of the traditional internal market in the early 1990s. The provisions are intended to improve conditions in the EU DSM to ensure that the market is as free and fair as it is safe for users of the digital economy. This interdisciplinary book analyses the impact of digital technologies on specific markets and, more broadly, the society and the economy. It identifies and assesses the different features, challenges, trends and dimensions of the EU DSM, from a legal and economic viewpoint, and also from a Polish perspective. Poland is presented as one of the EU countries participating in the creation of the EU DSM and is analysed alongside the average, as well as the best and the worst performing EU member states and compared with other non-EU members. The book addresses several broad areas in which the implications of digitalisation are particularly visible, and which are important to the average person: giant online platforms, freedom of speech, e-commerce, digital levy, energy infrastructure, and the labour market.
