Over the past two decades, European Union scholars have debated why the four principal southern states (Italy, Greece, Spain, and Portugal) have had significant problems complying with EU environmental directives. Although the theory of a uniquely "southern problem" has been somewhat discredited, the southern member states continue to be viewed as laggards in the environmental arena. To counter these accusations, Tanja Börzel developed the Pull-and-Push Model, which suggests that non-compliance is related to a variety of legal, administrative, and social factors. However, the model had not been tested by other scholars or on other European environmental policies. European Union Directive 2000/60/EC, more commonly called the Water Framework Directive (WFD), is a comprehensive policy aimed at improving the quality of all waters within the community's borders by 2015. The European Commission's midterm report, released in 2007, shows that compliance problems are occurring in the majority of member states. Additionally, some southern countries are actually performing better than their northern counterparts. This study focuses not only on the creation and implementation of the WFD, but uses Börzel's model to explain the compliance problems seen in Germany, an environmental "leader" state, and Spain, a "laggard" state. The results show that not only is the Pull-and-Push model applicable, but that compliance theories based in cultural and/or geographical biases are outdated and unconstructive.

The European Union, as a regulatory polity based on integration through law, arguably relies more on legal compliance with its policies than any other political system. Proceeding from this point of departure, this book puts the spotlight on the subnational tier and scrutinizes its role in ensuring compliance. Drawing on a dataset of infringement proceedings against federal and regionalized member states, the book shows that strong shared rule, i.e., strong cooperation between national and subnational authorities, can improve national compliance records. In contrast, policy sectors with strong redistributive consequences impair subnational authorities’ capacity to comply. In short, policy and politics matter more than polity.
