The importance of the fourteenth century for the development of English law has long been recognised. The shocks and challenges of that period - the murder of the incompetent Edward II, Edward III's ever escalating military demands for the war in France and the unparalleled disaster of the Black Death - gave English society a trauma that found its ultimate expression in Lollardy and the Peasants' Revolt. Out of this ferment came the evolution of a system of justice still substantially recognisable today. This key theme for students of late medieval England has often been made needlessly difficult by the rarefied nature of most books available on the subject. The aim of this book is to present in lucid and approachable terms the main outline of the debate and the different schools of thought, and to suggest the best ways by which students can understand a crucial subject and how this helps illuminate many other aspects of English society during the reigns of Edward II, Edward III and Richard II.

Focussing on the key role of the English medieval parliament in hearing and determining the requests of the king's subjects, this ground-breaking new study examines the private petition and its place in the late medieval English parliament (c.1270-1450). Until now, historians have focussed on the political and financial significance of the English medieval parliament; this book offers an important re-evaluation placing the emphasis on parliament as a crucial element in the provision of royal government and justice. It looks at the nature of medieval petitioning, how requests were written and how and why petitioners sought redress specifically in parliament. It also sheds new light on the concept of royal grace and its practical application to parliamentary petitions that required the king's personal intervention. The book traces the development of private petitioning over a period of almost two hundred years, from a point when parliament was essentially an instrument of royal administration, to one where it was self-consciously dispatching petitions as the highest court of the land. Gwilym Dodd considers not only the detail of the petitionary process, but also broader questions about the government of late medieval England. His conclusions contribute to our understanding of the nature of medieval monarchy, and its ability (or willingness) to address local difficulties, as well as the nature of local society, and the problems that faced individuals and communities in medieval society.

English Criminal Justice In The 19th Century written by David Bentley and has been published by Bloomsbury Publishing this book supported file pdf, txt, epub, kindle and other format this book has been release on 1998-07-01 with History categories.

An account of the 19th-century criminal justice system as a whole, from the crimes committed and the classification of offences to the different courts and their procedure. The author describes the stages of criminal prosecution -- committal, indictment, trial, verdict and punishment -- and the judges, lawyers and juries, highlighting the significant changes in the rules of evidence during the century. He looks at reform of the old system and assesses how far it was brought about by lawyers themselves and how far by external forces. Finally, he considers the fairness of the system, both as seen by contemporaries and in modern times.
