EU counter-terrorism is a hybrid policy that, despite its incremental, exogenous-shock-driven integration, has evolved from de facto intergovernmental governance to gradually heading towards harmonisation. As terrorism is not an EU competence, policy-making in the area was for many years short-term and reactive instead of driven by strategically coordinated prevention and response. Despite the bodies and mechanisms in place to facilitate information-sharing and operational cooperation, until 2015 the latter were lacking to such an extent as to cause gaps in governance and operational inefficiency, including decreased capacity for prevention and response. This study focuses on the necessity, unparalleled in any other EU policy area, for operational cross-border cooperation and information exchange. This text explores the aftermath of two critical junctures in EU counter-terrorism brought about by two sets of terrorist attacks - in Madrid (2004) and London (2005), as well as in Paris (November 2015) and Brussels (2016). This analysis is carried out through the lens of a dual theoretical framework - historical institutionalism (HI) and constructivist institutionalism (CI) - which is novel to the field of EU counter-terrorism, wherein HI has previously been applied to the policy's scholarly analysis, however a combination of the two theoretical branches has not been utilised in this area thus far. This thesis analyses the consequences of these junctures for the development of EU counter-terrorism by enquiring into the conditions and circumstances for institutionalisation of the policy and examining its added value to national efforts. The study demonstrates the increased efficiency of cross-border and inter-agency coordination in EU counter-terrorism since 2015 due to improved institutional design and legislative frameworks, leading to further policy integration.

The Treaty on the European Union stipulates that one of the key objectives of the Union is to provide citizens with a high level of safety within an Area of Freedom, Security and Justice. Given that the fight against terrorism is a prominent aspect of this general objective, it is remarkable that, in spite of its political relevance and decade-long history, it has only relatively recently received due attention in the academic community. Yet an analysis of the successes and failures of the EU's involvement in this field is imperative and this is a particularly pertinent moment to take stock of progress. The goal of this book is therefore to look back at the post-9/11 period and answer the question of whether, when it comes to the measures taken to combat terrorism following these attacks, the EU has lived up to the promise made in its founding treaties. Counter-Terrorism Networks in the European Union: Maintaining Democratic Legitimacy after 9/11 presents a model of democratic legitimacy for within international counter-terrorism co-operation. Exploring the current practices of European Union (EU) counter-terrorism policing, developed after 9/11, it highlights the current significant challenges to democratic legitimacy and seeks to present tools and solutions which ensure 'democratic' counter-terrorism actions and the protection of human rights. Counter-terrorism policing is now a global concern, with co-operation between security authorities of different countries a crucial feature in the fight to prevent terrorism and extremism. Yet, given the emphasis on pre-emption, this type of policing tends to interfere to a far greater extent with the rights of the individual than traditional policing. This book scrutinises the current focus of enhanced communication between counter-terrorist associates at member-state and EU levels within Europe, alongside analysis of just how far the traditional, protective mechanisms of accountability and oversight are managing to keep up with this development. It proposes that current forms of counter-terrorism policing within the EU should be understood as networks - sets of expert institutional nodes or individual agents, from at least two countries - that are interconnected in order to authorize and provide security with regard to counter-terrorism, using the European Police Office (Europol) as a key example.

This book traces the evolution of the EU’s fight against terrorism from the late 1970s until the end of the first decade after 9/11. This historical analysis covers both EU-internal and international counterterrorism policies and features an in-depth account of the EU’s reaction to the terrorist incidents in New York, Madrid and London. In the first few weeks after these incidents, the EU mobilised a complex but also incoherent set of policy measures, which significantly influenced the course of European security over the years. From a theoretical perspective, this volume argues that context-specific factors dominated over functionalist considerations in the EU’s fight against terrorism. Building on frameworks from public policy analysis, the author demonstrates that EU institutions played a critical role as policy entrepreneurs, while the many security measures were chosen on the basis of timing rather than significance. Such short-term political dynamics also explain the implementation deficits and persistent imbalances in the EU’s counterterrorism policy; limitations which still hinder its fight against international terrorism. This paper examines the EU's counter-terrorism policies responding to the Paris attacks of 13 November 2015. It argues that these events call for a re-think of the current information-sharing and preventive-justice model guiding the EU's counter-terrorism tools, along with security agencies such as Europol and Eurojust. Priority should be given to independently evaluating 'what has worked' and 'what has not' when it comes to police and criminal justice cooperation in the Union. Current EU counter-terrorism policies face two challenges: one is related to their efficiency and other concerns their legality. 'More data' without the necessary human resources, more effective cross-border operational cooperation and more trust between the law enforcement authorities of EU member states is not an efficient policy response. Large-scale surveillance and preventive justice techniques are also incompatible with the legal and judicial standards developed by the Court of Justice of the EU. The EU can bring further added value first, by boosting traditional policing and criminal justice cooperation to fight terrorism; second, by re-directing EU agencies' competences towards more coordination and support in cross-border operational cooperation and joint investigations, subject to greater accountability checks (Europol and Eurojust +); and third, by improving the use of policy measures following a criminal justice-led cooperation model focused on improving cross-border joint investigations and the use of information that meets the quality standards of 'evidence' in criminal judicial proceedings. Any EU and national counter-terrorism policies must not undermine democratic rule of law, fundamental rights or the EU's founding constitutional principles, such as the free movement of persons and the Schengen system. Otherwise, these policies will defeat their purpose by generating more insecurity, instability, mistrust and legal uncertainty for all.

The attacks of September 11 prompted the Bush Administration to improve law enforcement and other co-ordination between the United States and European governments dealing with international terrorism. European governments have also taken measures to enhance co-operation among themselves. However, by early 2002 the emphasis placed by the Bush Administration on military action beyond Afghanistan, and on strong support for the Sharon government in Israel in its conflict with Palestine, began to raise doubts among some Europeans about the overall US approach to counter-terrorism. This book offers a theoretically informed analysis of how coherently the European Union fights terrorism in the post-9/11 era. Few studies have looked at how the European Union has transformed into a relevant international anti-terrorist actor.
