As a hybrid regime, Hong Kong has been governed by a state-business alliance since the colonial era. However, since the handover in 1997, the transformation of Hong Kong’s political and socio-economic environment has eroded the conditions that supported a viable state-business alliance. This state-business alliance, which was once a solution for Hong Kong’s governance, has now become a political burden, rather than a political asset, to the post-colonial Hong Kong state. This book presents a critical re-examination of the post-1997 governance crisis in Hong Kong under the Tung Chee-hwa and Donald Tsang administrations. It shows that the state-business alliance has failed to function as an organizational machinery for supporting the post-colonial state, and has also served to generate new governance problems. Drawing upon contemporary theories on hybrid regimes and state capacity, this book looks beyond the existing opposition-centered explanations of Hong Kong’s governance crisis. By establishing the causal relationship between the failure of the state-business alliance and the governance crisis facing the post-colonial state, Brian C. H. Fong broadens our understanding of the governance problems and political confrontations in post-colonial Hong Kong. In turn, he posits that although the state-business alliance worked effectively for the colonial state in the past, it is now a major problem for the post-colonial state, and suggests that Hong Kong needs a realignment of a new governing coalition. Hong Kong’s Governance under Chinese Sovereignty will enrich and broaden the existing literature on Hong Kong’s public governance whilst casting new light on the territory’s political developments. This book examines the government of Hong Kong since its handover to mainland China in 1997, focusing in particular on the anti-government mass protests and mobilisations in the years since 2003. It argues that Hong Kong has been poorly governed since transferring to Chinese rule, and that public frustration with governmental performance, including anti-subversion laws and slow democratisation, has resulted in the regular and massive protests, which have been rare in Hong Kong's past political development. The book then assesses different explanations for Hong Kong's government problems, including lack of social cohesion, incomplete economic restructuring, structural budgetary deficit, severe social inequality, intensifying cronyism and deficiencies within the political system itself. It goes on to discuss the implications of poor governance for legislative elections, civil society and constitutional development, and considers the prospects for the future. It argues that although in the short-term the Hong Kong government has managed to maintain its popular support ratings, in the longer run it is unlikely to be able to maintain its legitimacy in dealing with the fundamental challenges of government unless the current system is replaced by popular election of the government with appropriate institutional capacity and political powers.

This book investigates the case of Hong Kong Special Administrative Region (SAR) of People’s Republic of China, mapping the changing patterns of political-administrative relations affected by the sovereignty change and structural reforms. It identifies the conditions that account for the varied political-administrative relations resulting from these changes, and develops an analytical framework that integrates and adapts theories and models from Western contexts to explain varied political-administrative relations in Hong Kong policymaking. The book tests its hypotheses through a qualitative comparative analysis of 18 cases occurring during the period of 1997–2012. It also conducts a comparative case analysis, which identified alternative causal conditions that were missing in the original framework. The book concludes that civil servants no longer dominate policymaking in Hong Kong after the regime change and structural reforms. While senior civil servants have sustained influence over policymaking processes through codified rules and political appointment, some of them have adapted to the changes in political environment that require more proactive policy styles and more hierarchical loyalty to the Central People’s Government of China than before. The first-hand interview materials presented in the book provide insights about internal political-administrative dynamics rarely accessible from the public domain. These insights provide inside knowledge of the actors, structure and processes of local policymaking in a context of post-colonial transition, and will be of interest to public administration scholars.

Statehood in the early 21st century remains as much a central problem as it was in 1979 when the first edition of The Creation of States in International Law was published. As Rhodesia, Namibia, the South African Homelands and Taiwan then were subjects of acute concern, today governments, international organizations, and other institutions are seized of such matters as the membership of Cyprus in the European Union, application of the Geneva Conventions to Afghanistan, a final settlement for Kosovo, and, still, relations between China and Taiwan. All of these, and many other disputed situations, are inseparable from the nature of statehood and its application in practice. The remarkable increase in the number of States in the 20th century did not abate in the twenty five years following publication of James Crawford's landmark study, which was awarded the American Society of International Law Prize for Creative Scholarship in 1981. The independence of many small territories comprising the 'residue' of the European colonial empires alone accounts for a major increase in States since 1979; while the disintegration of Yugoslavia and the USSR in the early 1990s further augmented the ranks. With these developments, the practice of States and international organizations has developed by substantial measure in respect of self-determination, secession, succession, recognition, de-colonization, and several other fields. Addressing such questions as the unification of Germany, the status of Israel and Palestine, and the continuing pressure from non-State groups to attain statehood, even, in cases like Chechnya or Tibet, against the presumptive rights of existing States, James Crawford discusses the relation between statehood and recognition; the criteria for statehood, especially in view of evolving standards of democracy and human rights; and the application of such criteria in international organizations and between states. Also discussed are the mechanisms by which states have been created, including devolution and secession, international disposition by major powers or international organizations and the institutions established for Mandated, Trust, and Non-Self-Governing Territories. Combining a general argument as to the normative significance of statehood with analysis of numerous specific cases, this fully revised and expanded second edition gives a comprehensive account of the developments which have led to the birth of so many new states.

On July 1st, 2007, Hong Kong celebrated the 10th anniversary of its return to the People’s Republic of China, but the past decade has been a bumpy ride for both the Hong Kong people and the central leaders in China. In fact, in 2003 Beijing had already succumbed to public pressure within the fairly short period of its rule by abruptly replacing its handpicked first Chief Executive with a British-groomed civil servant. This book examines the origin and evolution of Hong Kong’s political system, analyses the current contradictions in the system, and discusses how the system might develop in future. It focuses in particular on the office of Chief Executive in the context of Hong Kong’s transformation from a British colony to a Special Administrative Region in China. The dualistic structure of the Chief Executive’s office embodies a dilemma between two competing imperatives – Communist China’s imperative to retain a colonial political system where executive power is concentrated at the top; alongside the need to accommodate new, increasing demands for democratic representation within the territory.
