As a settler state, Canada’s claims to sovereign control over territory are contested by Indigenous claims to land and to self-determination. Indigenous Peoples and the Future of Federalism presents legal analyses that explore forms of federalism and their potential to include multiple and divided sovereignties. This collection aims to advance reconciliation with Indigenous peoples in Canada and elsewhere by developing jurisprudence on the possibilities for a nation-to-nation relationship between Indigenous nations and Crown sovereignty. Contributors use legal creativity to explore how federalism can be structured to include the constitutional jurisdiction of Indigenous nations. That mandate was for the negotiation of Whakatōhea's historical Treaty of Waitangi claims. The central complaint was that the Crown had breached the principles of the Treaty by failing to actively protect the claimants' ability to exercise their rangatiratanga and decide for themselves how they would settle their historical claims. The report looks at whether the Crown's decision to recognise the claims trust's deed of mandate was fair and reasonable and made in good faith. The Tribunal found that the Crown had failed to act reasonably, honourably, and in good faith and had thus breached the Treaty principles of partnership and active protection"--Publisher information.

The Ngatiwai Mandate Inquiry Report found the Crown breached the principles of the Treaty of Waitangi when it recognised the mandate of the Ngatiwai Trust Board to negotiate Treaty claims on behalf of iwi in October 2015. The report came after 10 claimant groups applied for an urgent inquiry into the Crown's recognition of that mandate. Urgency hearings were held at Whangarei's Toll Stadium in October last year and in Wellington in December. Claimant Mylie George of Ngatiwai ki Whangaruru said whanau welcomed the report.
