Excerpt from A History of Penal Methods: Criminals, Witches, Lunatics He started some few years back as a helpless baby, with a little bright, wondering face looking out on life. What has been impressed into it since then? It was a blank page, with only the water-mark of heredity, and a certain grade of quality and texture upon it. What have we written there? What has the whole community been doing to make these lines, now so deeply graven, or whence came they How is this stain on him, and there fore on all of us, to be cleared away? What must be done to help with a strong hand that will be criminology. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Excerpt from A History of Penal Methods: Criminals, Witches, Lunatics Criminology is the study of the causes and treatment of crime. To track the offender is a problem for the police; to determine his guilt or innocence is the work of the courts. Graphic accounts of his crime and capture, descriptions of his trial and conviction, or reports of the last scene when he stood upon the scaffold, are not criminology. The dreary records of convict mismanagement by the Governor of Gaolblank, and the ghastlycheerful reminiscences of the Chaplain of Chokee even the fascinating studies of, say, Edgar Poe, and Conan Doyle, in the art of Deduction are not criminology. We know now, and are beginning to realize, that nothing ever happens without a cause. A man can no more exist underived from the Past or effectless upon the Future, than he can walk suspended in the air. Therefore, when we look upon a person who is branded as a criminal, we have to account for him. He may be degraded enough as we find him, he may be a drunken, homeless wanderer or street-corner man, but what made him like this? He started some few years back as a helpless baby, with a little bright, wondering face looking out on life. What has been impressed into it since then? It was a blank page, with only the water-mark of heredity, and a certain grade of quality and texture upon it. What have we written there? what has the whole community been doing to make these lines, now so deeply graven, or whence came they? How is this stain on him, and therefore on all of us, to be cleared away? What must be done to help with a strong hand: that will be criminology. First Published in 1939, The Dilemma of Penal Reform presents Hermann Mannheim’s discussion on the impact of economic, social, and legal factors on methods of punishment. Set against the background of author’s wide knowledge in German, French, American and Soviet penal methods, the volume brings comparative analysis to address the question, whether it is possible to combine the old practice of making life inside prison less attractive than outside with the outlook aiming at the regeneration of prisoners, and to reconcile the stigma connected with a fair chance of rehabilitation. It also examines the conflict between the requirement of modern penology and some traditional principles of criminal procedure specially for the juvenile courts. One of the pioneering works in the history of Penal Reform, this book will be of interest to scholars and researchers of legal history, law, sociology, and social work.

Excerpt from Methods of Penal Administration in the United States: Notes of a Personal Enquiry, February and March, 1904 In the course of eight weeks it is quite impossible to obtain anything like an adequate view of so multifarious a subject as American penal administration. Ina vast Union, where each State has its own laws and institutions, - where some States are progressive and others backward; where one will spend money freely in trying to reform its criminals, while another thinks chiefly of their labour as an important source of revenue for the State; where some have experimented largely in trying substitutes for imprisonment, while others adhere to ancient methods, - the conditions vary so greatly that it is impossible in a few sentences to summarise ones impressions of the whole. The best method of conveying to others some of those impressions will be to deal consecutively with the chief classes of institutions visited, and the methods of administration which they illustrate. Punishment And Social Structure written by Otto Kirchheimer and has been published by Routledge this book supported file pdf, txt, epub, kindle and other format this book has been release on 2017-09-29 with Social Science categories.

Why are certain methods of punishment adopted or rejected in a given social situation? To what extent is the development of penal methods determined by basic social relations? The answers to these questions are complex, and go well beyond the thesis that institutionalized punishment is simply for the protection of society. While today's punishment of offenders often incorporates aspects of psychology, psychiatry, and sociology, at one time there was a more pronounced difference in criminal punishment based on class and economics. Punishment and Social Structure originated from an article written by Georg Rusche in 1933 entitled "Labor Market and Penal Sanction: Thoughts on the Sociology of Criminal Justice." Originally published in Germany by the Frankfurt Institute of Social Research, this article became the germ of a theory of criminology that laid the groundwork for all subsequent research in this area. Rusche and Kirchheimer look at crime from an historical perspective, and correlate methods of punishment with both temporal cultural values and economic conditions. The authors classify the history of crime into three primary eras: the early Middle Ages, in which penance and fines were the predominant modes of punishment; the later Middle Ages, in which harsh corporal punishment and capital punishment moved to the forefront; and the seventeenth century, in which the prison system was more fully developed. They also discuss more recent forms of penal practice, most notably under the constraints of a fascist state. The majority of the book was translated from German into English, and then reshaped by Rusche's co-author, Otto Kirchheimer, with whom Rusche actually had little discussion. While the main body of Punishment and Social Structure are Rusche's ideas, Kirchheimer was responsible for bringing the book more up-to-date to include the Nazi and fascist era. Punishment and Social Structure is a pioneering work that sets a paradigm for the study of crime and punishment.
