Counter-terrorism law and policy has been prominent and widespread in the years following 9/11, touching on many areas of everyday life from policing and border control to financial transactions and internet governance. The European Union is a major actor in contemporary counter-terrorism, including through its development of counter-terrorism laws for application within the Union. This book undertakes a multi-disciplinary and empirically informed analysis of the impact, legitimacy and effectiveness of EU counter-terrorism. Taking into account legal, societal, operational and democratic perspectives, this collection connects theoretical and practical perspectives to produce an interdisciplinary and multi-stakeholder study of how we might measure and understand the impact, legitimacy and effectiveness of EU counter-terrorism. Bringing together a select group of experts in the field, particular emphasis is placed on understanding the practical experience of implementing and assessing these measures gathered from and with end users, including law-makers, policy-makers, security services, industry partners and civil society. This edited collection will be of great relevance to scholars and policy makers with an interest in counter-terrorism law, EU law and security studies.

The Fundamental Right To Data Protection written by Maria Tzanou and has been published by Bloomsbury Publishing this book supported file pdf, txt, epub, kindle and other format this book has been release on 2017-06-01 with Law categories.

Since the entry into force of the Lisbon Treaty, data protection has been elevated to the status of a fundamental right in the European Union and is now enshrined in the EU Charter of Fundamental Rights alongside the right to privacy. This timely book investigates the normative significance of data protection as a fundamental right in the EU. The first part of the book examines the scope, the content and the capabilities of data protection as a fundamental right to resolve problems and to provide for an effective protection. It discusses the current approaches to this right in the legal scholarship and the case-law and identifies the limitations that prevent it from having an added value of its own. It suggests a theory of data protection that reconstructs the understanding of this right and could guide courts and legislators on data protection issues. The second part of the book goes on to empirically test the reconstructed right to data protection in four case-studies of counter-terrorism surveillance: communications metadata, travel data, financial data and Internet data surveillance. The book will be of interest to academics, students, policy-makers and practitioners in EU law, privacy, data protection, counter-terrorism and human rights law.

Socially Responsible Innovation In Security written by J. Peter Burgess and has been published by Routledge this book supported file pdf, txt, epub, kindle and other format this book has been release on 2018-05-03 with Political Science categories.

This book examines the possibility of socially responsible innovation in security, using an interdisciplinary approach. Responsible innovation in security refers to a comprehensive approach that aims to integrate knowledge related to stakeholders operating at both the demand and the supply side of security – technologists, citizens, policymakers and ethicists. Security innovations can only be successful in the long term if all the social, ethical and ecological impacts, and threats and opportunities, both short term and long term, are assessed and prioritized alongside technical and commercial impacts. The first part of this volume focuses on security technology innovation and its perception and acceptance by the public, while the second part delves deeper into the processes of decision-making and democratic control, raising questions about the ethical implications of security ruling. This book will be of much interest to students of critical security studies, sociology, technology studies and IR in general.

This volume collects and combines research on regional integration projects beyond Europe and in the Global South across a wide range of policy issues. Given the plurality and diversity of regional organisations, there is a growing need to systematically analyse, assess, and explain the performance of regionalism. Acknowledging the considerable differences in settings, institutional design, and politico-economic environment of regional organisations, the expert contributors move beyond EU-centric notions to offer a profound overview and propose new dimensions of innovative performance research. Systematic and in-depth research from Eurasia, Asia, Africa, and Latin America on organisations such as the Eurasian Economic Union, South Asian Association for Regional Cooperation, Indian Ocean Commission, Shanghai Cooperation Organisation, African Union, and the Organisation of American States, enables us to identify the conditions and determinants that shape performance across regions, actors, policy areas, and settings. The book provides readily accessible, important, and novel information to students and scholars of political science, international relations, EU and European studies, peace and conflict studies, comparative regionalism, interregional and inter-organizational studies, and area studies, and persons interested in specific policy fields such as trade, security, or development policy.

This is the second edition of EU Criminal Law, which has become since its publication in 2009 a key point of reference in the field. The second edition is updated and substantially expanded, to take into account the significant growth of EU criminal law as a distinct legal field and the impact of the entry into force of the Lisbon Treaty on European integration in criminal matters. The book offers a holistic and in-depth analysis of the key elements of European integration in criminal matters, including EU powers and competence to criminalise, the evolution of judicial co-operation under the principles of mutual recognition and mutual trust, EU action in the field of criminal procedure including legislation on the rights of the defendant and the victim, the evolving role of European bodies and agencies (such as Europol, Eurojust and the European Public Prosecutor's Office) in European criminal law, and the development of EU-wide surveillance and data gathering and exchange mechanisms. Several chapters are devoted to the external dimension of EU action in criminal matters (including transatlantic counter-terrorism cooperation and the impact of Brexit on EU Criminal Law) Throughout the volume, the constitutional and fundamental rights implications of European integration in criminal matters are highlighted. Covering all the key principles of EU law, with clear explanation and rigorous analysis, this will give scholars, students, policy makers and legal practitioners interested in the subject a strong understanding of this fascinating but sometimes complex field.

The European Union And Human Rights written by Jan Wouters and has been published by Oxford University Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 2020-12-17 with Law categories.

With the adoption of the Lisbon Treaty, the profile of human rights issues has greatly risen in relation to EU policies, whether internal or external. The EU has thereby made the commitment to ensure that all its actions are compliant with human rights, and seek to promote them. Yet, the EU's commitment has come under scrutiny, not only for its ground-breaking character, but also because recent events have put it to the test. This volume has been designed to take stock of these developments, to comprehensively discuss the conceptualization and operationalization of the EU's commitment to human rights throughout the EU's relationships, policies, actions and legislative activity, and to critically assess its outcome. This title is divided into four parts: 'Framework' presents the issues related to human rights promotion by the EU; 'Actors' delves into the relationships that play a part, at home or abroad, in regards to human rights policies and judgements; 'Policies' takes a case-study approach and systematically reviews a range of EU internal and external policies to assess their human rights impact and implementation; and finally, 'Strategies' provides an integrated assessment of the design and implementation of the EU's commitment to human rights. This book brings together essays from around the world, each discussing different aspects of EU commitment, and evaluating the extent to which the EU is delivering on it. Each chapter provides an introduction to the state of affairs, discusses opportunities and challenges, and provides recommendations. As such, it is an essential reference book on human rights policies throughout the EU and their impact throughout the world.

This book examines the vision and strategy of the EU’s Area of Freedom, Security and Justice (AFSJ), which has become one of the key objectives of the European Union (EU). Recent events have also highlighted the saliency of several of the policy issues at the heart of the AFSJ. Amongst them, one can mention the terrorist attacks in 2015 in Paris and 2016 in Brussels and the ongoing refugee crisis in the Mediterranean region. At the same time, the end of the Stockholm programme, which provided the strategic framework for the development of the AFSJ between 2010 and 2014, has been followed by the adoption of new ‘strategic guidelines’, which can only be described as a short, vague and general document.
