Excerpt from The Law and the Poor "But, say what you like, our Queen reigns over the greatest nation that ever existed." "Which nation?" asked the younger stranger, "for she reigns over two." The stranger paused; Egremont was silent, but looked inquiringly. "Yes," resumed the stranger after a moment's interval. "Two nations; between whom there is no intercourse and no sympathy; who are as ignorant of each other's habits, thoughts, and feelings, as if they were dwellers in different zones, or inhabitants of different planets; who are formed by a different breeding, are fed by a different food, are ordered by different manners, and are not governed by the same laws." "You speak of -," said Egremont, hesitatingly. "The Rich and the Poor." Benjamin Disraeli: "Sybil, or The Two Nations." The rich have many law books written to protect their privileges, but the poor, who are the greater nation, have but few. Not that I should like to call this a law book, for two reasons: firstly, it would not be true; secondly, if it were true, I should not mention it, as I want people to read it. You cannot read law books, you only consult them. A law book seeks to set out the law, the whole law, and nothing but the law on the subject of which it treats. There are many books on Poor Law, there are hundreds of volumes about the Poor, and many more about the Law, but the Law and the Poor is a virgin subject. Excerpt from The Poor Law: A Proposal for Its Abolition When society makes a law by which every one of its members is protected against the consequences of his idle fuess or want of thrift, to whatever extent these may be pushed, a course is adopted exactly opposite to that which is pursued by Nature. Society in England says to the lazy and unthrifty, If you do not care to work, you shall be supported by the State you shall not, indeed, be provided with luxuries, but you shall have sufficient food and shelter; you need not fear that any serious task of work will be demanded of you. If, during your youth and manhood, you choose to labour, Well and good, but it is not necessary for you to lay up a provision for sickness or old age; you can spend all your spare cash on beer, gin, and luxuries, because you will be provided for at the public charge, in decency and tolerable comfort, when you are no longer able to work Nature, on the other hand, says to man, in unmistakable Fan guage, If you do not work, you shall die like a dog in a ditch. Is the method of Society, or that of Nature, more merciful? About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Excerpt from Practice of the Scottish Poor Law As a result of many conversations with Inspectors of Poor, Parish Councillors, and Parish officials generally, I have come to think that there is a real need for a little manual of Poor Law practice. Since the publication of Mr. Guthrie Smith's classic book some forty years ago, nothing of this kind has been attempted. It is true that Mr. Graham, in a most valuable work on Poor Law, has collected all the Acts and decisions, and linked them together with lucid notes. But Mr. Graham necessarily dwells on the strictly legal side of his subject. To one engaged in active Poor Law work, the practice appeals more strongly than the law, and accordingly the present book is more a manual of practice than any of its predecessors. In dealing with the law of Settlement and Recourse, I have endeavoured, as far as possible, to express the law in the form of general propositions, and have avoided argument upon debatable points. I have not set for myself any high aim, as I know that many Inspectors of Poor, from long experience, and from native shrewdness, have acquired such a mastery of the law of Settlement that one must not expose the weak places in his armour to the shafts of their criticism. But I am hopeful that Assistant Inspectors, Inspectors of the smaller parishes who may not have all the authorities at command, and especially new Inspectors, may find my notes useful. Excerpt from The Poor Law Legal provision for the relief of the destitute is not, like other national institutions, - for instance, Parliament, courts of justice, or a standing army, - a plain and necessary part of civilised social organisation, requiring no explanation and needing no defence. On the contrary, such provision would seem at first sight artificial and even unnatural, for it establishes a state of things in which persons are not obliged, unless they choose, to provide themselves with the means of subsistence; while those who work for their own living are compelled, whether they like it or not, to maintain those who will not or cannot support themselves. Hence it is always found necessary, in treating of this subject, to begin by showing why there ought to be and in point of fact must be a Poor Law before we can discuss profitably what Poor Laws ought to be, or describe what they have been.
