John Perkins, writing in 1642, says: 'If a man contract with a Phisitian, or with a Surgion, that if he should cure such an one, and name him certaine, of such a disease, and name the disease, that he should have ten pounds, the same is a good contract conditionall.' A contract on the terms fNo cure, no pay' is rare, although the parochial medical officer receives but half the full fee if his patient die within thirty-six hours of the operation--a period of limitation which was set when the effects of shock were more appreciated than were the results of septic infection. Excluding such exceptions, a general practitioner does not, if he is wise, undertake to cure diseases, but to treat his patients; nor does he guarantee to use the highest possible degree of skill; he undertakes the exercise of reasonable knowledge, intelligence, and ability, in faithful attendance, in the selection or retention of independent contractors, and in necessary advice as to precautions to be taken in the future. No absolute liability is recognized. 'Success is nought. Endeavour's all.' But a medical practitioner must not suddenly and without reasonable notice cease visiting and treating a patient, and he must leave instructions how to proceed when his visits cease. Surgeons and accoucheurs are perhaps the practitioners most often pursued by litigants with charges of Negligence in doing those things which they ought not to have done.
