'Protected tenants' are tenants living in premises which are covered by the provisions of the Landlord and Tenant (Amendment) Act 1948 ('1948 Act'). While most residential tenancies in New South Wales are now regulated by the Residential Tenancies Act 2010 ('2010 Act'), the 1948 Act may apply for: * tenancies which commenced before 1 January 1986; in* premises that were built before 16 December 1954 (and, if converted into units, the conversion was before 1 January 1969); where* a 5A lease has not been registered. The rights and obligations of parties under the 1948 Act are significantly different from those in the 2010 Act, particularly in the areas of rent-setting, evictions and repairs. Protected tenants are generally vulnerable occupants, due to their age or disability. This vulnerability, combined with issues involving potential profits from decontrolling premises and the complexity of the 1948 Act, makes this area of advice and advocacy very challenging for tenancy workers. This Guide aims to assist in identifying protected tenancies, to introduce tenancy workers to the issues for protected tenants and to support initial general advice. Further casework should always be undertaken with the support of expert legal advice. Individuals and service providers should not rely solely on the general information in this guide.
