Excerpt from The Law of Specific Relief in British India The author of this work, which has now attained the posi tion of a classic in Indian legal literature, was a lawyer and a scholar of consummate ability. The University of Calcutta as well as the University of Allahabad are justly proud of his academic achievements which were of the highest order. A Premchand Roychand Student of the former and a Doctor of Laws of the latter, he established a claim that he had no peer among his contemporaries in either University. In 1906, he was a candidate for the Tagore Professorship in the University of Calcutta and, though he had to count amongst his competitors at least one distinguished scholar, who has since attained the highest rank in the profession, his success was a foregone conclusion. The judgment of those who advocated his appointment was amply justified by the result. The monumental work, which has now reached its second edition, was, on its first publication, acclaimed in legal circles as a triumph of erudition and research, while the accuracy and lucidity of the exposition of legal principles which throughout characterized the work marked it out as a contribution of enduring value. It has stood the test of criticism remarkably well, and lawyers, who have had recourse to its pages frequently, have not discovered in it any serious flaw or error. Dr. Satischandra Banerjee passed away in the plenitude of his powers and in the midst of many-sided activities of unquestionable value to his community; and the work before us cannot fail to convince an impartial reader how great has been the loss to legal literature by reason of his untimely death. Excerpt from The Law of Trusts in British India At the time when these lectures were delivered by Mr. F. W. Agnew, the Law of Trusts in British India was no more than the law of England administered in the Indian territories. The Indian Trusts Bill was then on the anvil and in the year following it became law. It was a statutory expression of the law of private trusts, but for reasons unknown, the Act has not been extended in its operation to the whole of British India. The Statutes of Elizabeth on Fraudulent Conveyances have been replaced by the provisions of the Transfer of Property Act and that of Victoria on Insolvent Debtors by the Provincial and the Presidency-Towns Insolvency Acts. The Official Trustees' and Administrator-General's Acts have been revised and re-enacted. In the field of public trusts the Charitable Endowments Act is the sole piece of legislation. Beyond relieving the Government of its responsibility for the working of some institutions of public interest, the Religious Endowments Act has done no real good but the lethargy of the Legislature has conferred on it an ill-deserved longevity. The Charitable and Religious Trusts Control Act has now been passed and the merits of the measure must rest for future appreciation. To the learned Judiciary, the chapters on Benami Transactions and Religious Trusts owe their particular magnitude.
