In 1808 the legislature of the Louisiana territory appointed two men to translate the Digest of the Laws in Force in the Territory of Orleans (or, as it was called at the time, simply the Code) from the original French into English. Those officials, however, did not reveal who received the commission, and the translators never identified themselves. Indeed, the “translators of 1808” guarded their secret so well that their identities have remained unknown for more than two hundred years. Their names, personalities, careers, and credentials, indeed everything about them, have been a missing chapter in Louisiana legal history. In this volume, Vernon Valentine Palmer, through painstaking research, uncovers the identity of the translators, presents their life stories, and evaluates their translation in the context of the birth of civil law in Louisiana. One consequence of the translators' previous anonymity has been that the translation itself has never been fully examined before this study. To be sure, the translation has been criticized and specific errors have been pointed out, but Palmer's study is the first general evaluation that considers the translation's goals, the Louisiana context, its merits and demerits, its innovations, failures, and successes. It thus allows us to understand how much and in what ways the translators affected the future course of Louisiana law. The Lost Translators, through painstaking research, uncovers the identity of the translators, presents their life stories, and evaluates their translation in the context of the birth of civil law in Louisiana.

In histories of enslavement and in Black women's history, coercion looms large in any discussion of sex and sexuality. At a time when sexual violence against Black women was virtually unregulated—even normalized—a vast economy developed specifically to sell the sexual labor of Black women. In this vividly rendered book, Emily A. Owens wrestles with the question of why white men paid notoriously high prices to gain sexual access to the bodies of enslaved women to whom they already had legal and social access. Owens centers the survival strategies and intellectual labor of Black women enslaved in New Orleans to unravel the culture of violence they endured, in which slaveholders obscured "the presence of force" with arrangements that included gifts and money. Owens's storytelling highlights that the classic formulation of rape law that requires "the presence of force" and "the absence of consent" to denote a crime was in fact a key legal fixture that packaged predation as pleasure and produced, rather than prevented, violence against Black women. Owens dramatically reorients our understanding of enslaved women's lives as well as of the nature of violence in the entire venture of racial slavery in the U.S. South. Unsettling the idea that consent is necessarily incompatible with structural and interpersonal violence, this history shows that when sex is understood as a transaction, women are imagined as responsible for their own violation.

A new definitive volume of the retirement papers of Thomas Jefferson This volume’s 627 documents feature a vast assortment of topics. Jefferson writes of his dread of “a doting old age.” He inserts an anonymous note in the Richmond Enquirer denying that he has endorsed a candidate for the next presidential election, and he publishes two letters in that newspaper under his own name to refute a Federalist claim that he once benefited by overcharging the United States Treasury. Jefferson does not reply to unsolicited letters seeking his opinion on constitutional matters, judicial review, and a call for universal white male suffrage in Virginia. Fearing that it would set a dangerous precedent, he declines appointment as patron of a new society “for the civilisation of the Indians.” Jefferson is also asked to comment on proposed improvements to stoves, lighthouses, telescopes, and navigable balloons. Citing his advanced age and stiffened wrist, he avoids detailed replies and allows his complaint to John Adams about the volume of incoming correspondence to be leaked to the press in hopes that strangers will stop deluging them both with letters. Jefferson approves of the growth of Unitarianism and predicts that “there is not a young man now living in the US. who will not die an Unitarian.”
