This report makes a number of conclusions and recommendations for revised procedures so that it is easier for the general public, as well as lobby groups, representative organisations and other stakeholders to influence Parliament's consideration of bills. Issues discussed include: the volume of legislation; pre-legislative scrutiny; information about bills; programming; second, committee and third reading stages; consideration of Lords amendments; timing of votes; and resource implications. Recommendations include that pre-legislative scrutiny of draft bills should become more widespread, and as a matter of routine, Government bills should be referred to committees with the power to take evidence and to amend bills. For greater clarity, standing committees should be renamed as 'public bill committees' in relation to bills and 'delegated legislation committees' in relation to statutory instruments. The standing committee stage could be improved by increasing the notice period for amendments, and the Commons should begin to computerise standing committee papers and provide on-screen access to papers in committee rooms. There should be a more flexible approach to the timing of bills to allow for longer second reading debates on some bills and shorter debates on others as required. Parliament should improve the quality of its information provision, using a series of 'legislation gateways' on its internet site to provide a single source of information for each bill, and there should be greater use of information currently available, such as the Government's Regulation Impact Assessments.

The EU's ambitious Financial Services Action Plan, started in 1999, is drawing to an end. A single market in wholesale financial services exists. Many retail financial services institutions are expanding through acquisitions of banks and insurers across Europe, though the prospect of a single market in such services, with comparable products and services available to consumers direct across borders, is not a realistic proposition in the near future. The Commission has set out its policy objectives for 2005-2010, attaching greater importance to consistent and workable implementation of existing legislation. The Committee welcomes this, and the commitment to ensure that any new regulation will have a clear benefit to the European economy. The Committee examined three specific case studies: implementation of the Markets in Financial Instruments Directive (MiFID), the consideration of a Clearing and Settlement Directive, and consideration of mortgage credit in the context of the development of a single market in retail financial services. In all the Commission will need to demonstrate its commitment to "better regulation", and its new focus on implementation and enforcement. The Committee is concerned that MiFID will not be implemented consistently across Europe. It finds that the case for a new mortgage directive remains unproven, and that there is a clear need to reduce the additional costs associated with clearing and settlement across borders.

The Committee has set out a number of conclusions and recommendations, including: the Committee believes that the use of plain English in the Draft Legislative Programme is to be commended, and the Government should consider extending the approach to programmed Bills on a trial basis; that the Government's main non-legislative plans should be included in the Draft Legislative Programme, alongside the list of proposed bills, in order that a full programme of government is available for scrutiny; that there is a benefit to be derived from the presentation of the Government's legislative programme as a whole and that the Draft Legislative Programme should be published earlier in the year, preferably before Easter, so that select committee scrutiny and public consultation can be carried out more effectively; that the Draft Legislative Programme should be the subject of a separate debate in Parliament.

The Sewel Convention seeks to ensure that the UK Parliament legislates on devolved matters only with the express agreement of the Scottish Parliament, and consent is also required for legislation on reserved matters if it alters the powers of the Scottish Parliament or Scottish Ministers. Following on from a report by the Scottish Parliament Procedures Committee on the operation of the Convention (SP paper 428, 7th report, session 2 (2005) (ISBN 1406113220) published in October 2005), the Committee's report focuses on ways of improving the communications procedure between the Scottish and Westminster Parliaments, and how MPs could be better alerted that a particular Bill before Parliament had been subject to a Sewel motion in the Scottish Parliament. Recommendations made include: the introduction of a formal process whereby the Scottish Parliament notifies Westminster when a Sewel motion has been passed and the 'tagging' of all relevant public Bills; and the need for an explicit statement on explanatory notes to Bills as to which parts of the UK the provisions will affect. The report also recommends the further consideration of the need to establish a 'Super' Scottish Grand Committee, composed of Scottish MPs, MSPs and Scottish MEPs, to discuss matters of mutual interest.

The Governance of Britain Green Paper (Cm. 7170, ISBN 9780101717021) put forward proposals for improved democractic accountability and scrutiny of the delivery of public services in the English regions. The Committee, in this report, has concluded that there is clear evidence of an accountability gap at regional level. Regional Development Agencies (RDAs), although accountable to ministers, still conduct many activities that are not subject to a regular, robust scrutiny, and the Committee believes more should be done to monitor the delivery of services. With this in mind, the Committee recommends the establishment of a system of regional select committees, with one select committee for each of the administrative regions in England, with the exception of London. Further, the Committee recommends that up to two regional grand committee meeting should take place in each session for each of the 8 regions. To avoid an adverse impact on House Members' other commitments, membership of regional committees should consist of 10 Members in total. This report therefore sets out a desirability of establishing new structures within the House of Commons to improve regional accountability and Parliamentary scrutiny.

This report follows on from the Committee's report of May 2007, HC 513, session 2006-07 (ISBN 9780215034168). Both in that report and the Government's reply to it, support was expressed in principle for an e-petitioning system for the House of Commons. Historically it has always been seen as the right of every commoner to prepare and present petitions to the House of Commons in case of grievance and the House to receive and respond to them. The suggested scheme retains the direct involvement of constituency Members of Parliament in the petition procedure. It is proposed that: E-petitions are submitted via the Parliamentary website; if they comply with the House's rules, the petitioner's constituency MP will be asked to act as facilitator; the e-petition is then posted on the website for a set period - allowing others to add their name if they wish; at the end of the period, it is closed; it is then presented to the House; petitioners and signatories may opt in to receive updates; e-petitions will be printed in Hansard and sent to select committees and may be considered by them; the Government will normally be expected to reply within 2 months; on three occasions each year; certain e-petitions will be debated by the House of Commons in Westminster Hall. The Committee acknowledges that setting up an e-petitions scheme is not without risks. Its successful implementation will require new ways of working and novel forms of governance. However, e-petitioning is also seen as having the potential to open up proceedings and make a major contribution to the House's strategic objective to 'make itself more accessible, to make it easier for people to understand the work of the Parliament and do more to communicate its activity to the general public'

The draft Local Transport Bill consists of a package of measures intended to promote stronger joint working between local authorities and bus operators, to support the introduction of local road pricing schemes and to enable changes to be made to local transport governance. This report follows the structure of the draft Bill. Although the remarks are related to specific clauses some of the recommendations have a more general application. Included with the report is consideration of the Transport Innovation Fund, which is closely linked to congestion and the draft Bill. The Committee is however unhappy that at the end of their inquiry the Secretary of State announced further consultation on parts of the Bill related to the powers and status of the traffic commissioners on reform of the Bus Service Operators' Grant and transitional arrangements for quality contract schemes.

There has been repeated criticism in recent years from a variety of sources about both the quantity and quality of legislation. The Committee's inquiry into Ensuring standards in the quality of legislation has considered these criticisms, analysed the core problems and causes of bad quality legislation, and looked to provide solutions for both the Government and Parliament to improve the quality of legislation. The Scottish Parliament, Northern Ireland Assembly and National Assembly for Wales have adapted the Westminster model in order to improve the quality of their legislation; it is now the turn of Westminster to look at their processes and adapt them for use here. The Committee has concluded that it would be beneficial for Parliament and the Government to work together to agree standards for what makes good legislation, and as a starting point for discussion publishes a draft Code of Legislative Standards with the report. The Committee also recommends the creation of a Joint Legislative Standards Committee to provide oversight of the Cabinet's Parliamentary Business and Legislation Committee's approach to and use of the finalised Code of Legislative Standards, to ensure that the quality standards set out in the Code of Legislative Standards are met. The Committee considers that these recommendations would also improve the quality of constitutional legislation, in particular, by requiring the Government to adopt an agreed test to identify constitutional legislation and thereby improve Parliament's scrutiny of it

The Committee's report examines the small claims system in the county court, focusing on the following issues: provision of IT facilities and listing procedures, enforcement of judgements, limits on claims for personal injury and housing disrepair, and proposals for a European Small Claims Procedure to cover cross-border cases. The Committee finds that the small claims system generally works well in providing a low cost, good quality procedure for large numbers of litigants which is more informal and quicker than ordinary proceedings. However, the report also identifies a number of areas for improvement, including the need to introduce electronic document management and listing software to increase work efficiency; to improve enforceability of judgements; and to review financial limits for claims relating to personal injury and housing disrepair.
