The absence of a security dialogue and agreement among competing internal and external actors has rendered the well-intentioned Skhirat accord impossible to fully implement at this time. It is critical to return to hammer out a security agreement that can be married to those elements of the accord that both sides support. On its current trajectory, the peace process is headed for a failure that would leave pressing international issues unresolved, such as combating people-smugglers and jihadist groups, and ensure dramatic worsening of living conditions for most Libyans. What has been achieved by the UN-led negotiations – broad agreement on the need for a transitional framework and some of its critical political elements – would be lost. The December 2015 agreement could have been imposed on recalcitrant actors had they been marginal and the international community united. That was not the case. Salvaging a political solution requires dealing with the fragmented and deeply frustrating Libya that exists, with its local leaders and armed groups, not the one we wish for.

Since 2011 the Libyan crisis has moved from being a domestic dispute to assuming increasing importance at the international level. Today it represents a crucial issue affecting global security. The intervention of external actors in the Libyan crisis was mainly driven by a desire to direct the transition towards outcomes that would best meet their own political and economic interests. Accordingly, each external player tried to support one specific faction, favoring either the Parliament in Tobruk, upheld by Khalifa Haftar, or the Presidential Council headed by Fayez al-Serraj in Tripoli, the latter being legitimized by the UN as well as by local militias in both Misrata and Tripoli. This report analyzes the troublesome re-building of Libya with a focus on the specific role played by international actors (neighboring and Gulf countries, European nations, Russia and the US) which make it more of an international rather than a domestic issue.

The launch of Operation Dignity in May 2014 transformed Libya’s low-level military and political conflict into a full-blown war. The seizure of Tripoli and much of western Libya by the opposing Libya Dawn movement left the country divided in two with two parliaments, two governments, and two putative armies. The violence of the last year has left the country on the brink of economic, social, and political meltdown, and provided an opportunity for the organization known as Islamic State (IS) to proliferate. If Libya goes over the edge, this will have major consequences for Europe and the region: Libya will become a base for launching terrorist operations for the foreseeable future and the scale of illegal migration and other forms of smuggling will reach previously unimaginable proportions. The international community’s efforts to resolve the crisis, particularly those of the United Nations Support Mission in Libya (UNSMIL), have failed to prevent this collapse. UNSMIL’s initial approach to solving the division of Libya’s elected parliament, the House of Representatives (HoR), did not engage key decision makers and bred mistrust on the part of the Libya Dawn camp. Consecutive drafts of a political agreement failed to reconcile the fundamental interests of each side and met with opposition from one side or another. Armed actors on both sides were not sufficiently engaged and are not invested in the solution currently on the table. The decision to close the draft agreement to further amendments and initial the agreement in Skhirat, Morocco, on 11 July, 2015, without the support of major components from the Libya Dawn camp was a risky strategy which has very limited chances for success. If this strategy fails and the agreement cannot produce an inclusive Government of National Accord, then the international community will have no choice but to pursue a more long-term and multidimensional strategy. This strategy would not eschew the possibility of a high-level political agreement, but would attempt to facilitate it.

Multiple governing entities and their allied militias and armed forces compete for power while the U.N.-backed unity government, known as the Government of National Accord, remains unable to provide basic security and basic services to the people of Libya. Criminals and terrorist groups, including ISIS, al-Qaeda and so many others, take advantage of the chaos, securing their own territory and using Libya as a launching pad for smuggling, human trafficking, and terror attacks.
