Although much has been written about the history of copyright and authorship in the eighteenth and nineteenth centuries, very little attention has been given to the impact of the development of other kinds of intellectual property on the ways in which writers viewed their work in this period. This book is the first to suggest that the fierce debates over patent law and the discussion of invention and inventors in popular texts during the nineteenth century informed the parallel debate over the professional status of authors. The book examines the shared rhetoric surrounding the creation of the 'inventor' and the 'author' in the debate of the 1830s, and the challenge of the emerging technologies of mass production to traditional ideas of art and industry is addressed in a chapter on authorship at the Great Exhibition of 1851. Subsequent chapters show how novelists Charles Dickens, Elizabeth Gaskell, and George Eliot participated in debates over the value and ownership of labour in the 1850s, such as patent reform and the controversy over married women's property. The book shows the ways in which these were reflected in their novels. It also suggests that the publication of those novels, and the celebrity of their authors, had a substantial effect on the subsequent direction of these debates. The final chapter shows that Thomas Hardy's later fiction reflects an important shift in thinking about creativity and ownership towards the end of the century. Patent Inventions argues that Victorian writers used the novel not just to reflect, but also to challenge received notions of intellectual ownership and responsibility. It ends by suggesting that detailed study of the debate over intellectual property in the nineteenth century leads to a better understanding of the complex negotiations over the bounds of selfhood and social responsibility in the period.

This book offers a theory of democratic justice. According to the theory, justice emerges from collective agreement among political associates who enjoy approximate equality of power. Such situations can be seen as social contracts, and we find an empirical model for social contracts in the examples of successful common property resource regimes. In these regimes, participants craft collective rules of access to the means of production on an equal basis and producers are entitled to the full fruits of their labour. To interpret this theoretically an account of practical rationality in terms of individual and public deliberation is required. In tracing the move from small scale to large scale societies, three important transformations become apparent: in political institutions; in the economy; and in the functions of the household. All are relevant to the understanding of justice. In great societies representative parties making policy and law in shifting coalitions in parliaments elected by proportional representation exemplify political equality and so instance one form of democratic justice. In the economy corporate hierarchies modify the full fruits principles, not always in the direction of justice. Redistribution is justified as a means of smoothing income across the life-cycle, rather than by appeal to economies of scale or a simple principle of need. The sense of democratic justice requires commitment to the maintenance of those institutions that protect common interests, whilst acknowledging where there are differences of interest. This sense of democratic justice needs to be upheld by effective governance.

Property remains the bedrock of the societies we all inhabit. It underpins our core institutions - including families, states and economies - and it is the medium through which the intensifying politics of inequality is played out. There is plenty of evidence that its importance is increasing in a world of growing wealth inequality and depletion of natural resources. Volume Two of Just Property traces the development of ideas about property in the Western world from the early eighteenth century, through the Enlightenment and the experience of the French Revolution, to the critical stance of socialists and anarchists in the nineteenth century. It ranges across the thought of Bernard Mandeville, David Hume, Adam Smith, Voltaire, Rousseau, Kant, Hegel, the Abbe de Sieyes, Burke, Wollstonecraft, Charles Fourier, Karl Marx, Proudhon and Peter Kropotkin. Many themes persist from an earlier period, as does the influence of Christianity and the Roman Law but there are also many innovations. In general, the authority of God and the natural law recedes and the themes of utility and securing general welfare became more prominent. In the wake of Locke, labour, though sometimes in the form of 'past labour', that is capital, attains a new prominence. For its admirers, a newly-unfettered private property is the means of securing personal freedom, constraining authoritarian governments, promoting the arts and sciences, and delivering an unprecedented improvement in the material condition of the whole population. For its critics, private property is the central component in a new political economy of systemic and unlimited class exploitation. It penetrates everywhere and corrupts everything that it touches. With these arguments, we are clearly on the terrain of modernity, witnessing a set of arguments and counter-arguments with which we all still struggle.
