Despite the increasing popularity of “religion and science” as an academic discourse, the intersection of science and religion remains a front line in an ongoing “culture war.” The reasons for this lie in an approach to discourse that closely resembles the model of discourse promoted by John Rawls, in which plural discourse —such as between religion and science— is based on a foundation of shared beliefs and established facts. This leads to a “doctrines and discoveries” approach to the relationship of religion and science, which focuses on their respective truth claims in an attempt to find areas of agreement. This framework inherently privileges scientific perspectives, which actually increases conflict between religion and science, and undermines public discourse by inserting absolutes into it. To the extent that the science and religion discourse adopts this approach, it inadvertently increases the conflict between religion and science and limits our ability to address matters of public concern. This book suggests an alternative model for discourse, a disputational friendship, based on the work of Hannah Arendt. This approach recognizes the role that authorities —and thus religion and science— play in public life, but undermines any attempt to privilege a particular authority, because it promotes the position of the storyteller, who never settles on a single story but always seeks to incorporate many particular stories into her account. A disputational friendship promotes storytelling not by seeking agreement, but by exploring areas of disagreement in order to create the space for more conversations and to generate more stories and additional interpretations. Successful discourse between religion and science is not measured by its ability to determine “truth” or “fact,” but by its ability to continually expand the discourse and promote public life and public judgment.

The Rabbis of the first five centuries of the Common Era loom large in the Jewish tradition. Until the modern period, Jews viewed the Rabbinic traditions as the authoritative contents of their covenant with God, and scholars debated the meanings of these ancient Sages words. Even after the eighteenth century, when varied denominations emerged within Judaism, each with its own approach to the tradition, the literary legacy of the talmudic Sages continued to be consulted. In this book, Michael S. Berger analyzes the notion of Rabbinic authority from a philosophical standpoint. He sets out a typology of theories that can be used to understand the authority of these Sages, showing the coherence of each, its strengths and weaknesses, and what aspects of the Rabbinic enterprise it covers. His careful and thorough analysis reveals that owing to the multifaceted character of the Rabbinic enterprise, no single theory is adequate to fully ground Rabbinic authority as traditionally understood. The final section of the book argues that the notion of Rabbinic authority may indeed have been transformed over time, even as it retained the original name. Drawing on the debates about legal hermeneutics between Ronald Dworkin and Stanley Fish, Berger introduces the idea that Rabbinic authority is not a strict consequence of a preexisting theory, but rather is embedded in a form of life that includes text, interpretation, and practices. Rabbinic authority is shown to be a nuanced concept unique to Judaism, in that it is taken to justify those sorts of activities which in turn actually deepen the authority itself. Students of Judaism and philosophers of religion in general will be intrigued by this philosophical examination of a central issue of Judaism, conducted with unprecedented rigor and refreshing creative insight.

Challenging the prevailing understanding of the authority of law, Daniel Mark offers a theory of moral obligation that is rooted both in command and in the law’s orientation to the common good. When and why do we have an obligation to obey the law? Prevailing theories in the philosophy of law, starting with the work of H. L. A. Hart and Joseph Raz, fail to provide definitive answers regarding the nature of legal obligation. In this highly original and effective new work, Daniel Mark argues that there is a prima facie moral obligation to obey the law simply because it is the law. In Mark’s view, the best concept of law—one that allows for the possibility of justified authority and obligation—defines law as a set of commands oriented to the common good. Legal obligation, he proposes, shares defining features with moral obligation and with religious obligation while aligning wholly with neither. This philosophically coherent view of legal obligation offers a viable framework for analyzing important and seemingly paradoxical puzzles about the law, such as why civil disobedience is punished as lawbreaking or why war-crimes trials for legal but immoral acts present a moral quandary.
