Excerpt from The New German Constitution The rhythm of human affairs is such that we may reason ably expect a return to the constitutional searchings of 1912 on a higher and different plane. Those who fix their eyes not upon the written letter of our Constitution, but upon judi cial decisions, political practice, and congressional procedure are never under the delusion that our constitutional system does not change. If, as Professor Seligman long ago pointed out, economic conditions are rapidly becoming the same all over the world with similar legal results, then we may, with proper warrant, expect very soon a new and lively examina tion of constitutional principles to break in upon us. M. Brunet's book fits in with the signs of the times. No person who pretends to be intelligent about constitutional matters can neglect it. It would be difficult to imagine anything more illuminating than a comparison of the Constitution of the United States drawn up in 1787, the fundamental law of the Australian Commonwealth adopted in 1900, and the new German Reichsverfassung of 1919, which vibrates with the tramp of the proletariat. In the attempt of the Germans to combine the strength of Hamilton's government with the democratic control so vaunted by Jefferson we have an experiment that ought to stir our deepest interest. In the provisions for social, not to say socialistic, enterprise, both the Australian and the German constitutions ofi'er noteworthy contrasts to our own fundamental law. It will not escape the close observer that the Germans have not created a Supreme court, on the model of our own, endowed with power to set aside acts of the executive and legislative branches of the government. The relations established by the Germans between the federal government and the states, ingenious compromises all must admit, ought to be studied in connection with Mr. Roosevelt's New Nationalism - not as an echo of a dead past but as a prophecy of the future. Excerpt from The North German Confederation Immediately upon the close of the deliberations of the Reichs tag, which covered a period of two months, the constitution as amended was adopted by the assembly of envoys, whereupon it was submitted by the governments to the legislatures of their several states and approved by the latter in the form prescribed for constitutional amendments in each state. The constitution thus adopted should have been promulgated either by the associated governments or by the governments and the Reichs tag jointly. It was, as Binding points out, an anomaly that a national constitution should be promulgated by state govern ments. Strangely, however, neither the manner of promulga tion nor the question when the new constitution should go into effect, had received any attention from what we may be justified in calling the new federal authorities. This omission was supplied by the state governments which promulgated the constitution, through the insertion of an identical provision that on the 1st of July, 1867, it should go into effect in the promulgating state. Ratification by state legislatures and promulgation on state authority are facts to which Seydel appeals as proof that the constitution is not a federal law but an identical law of the several states. Binding holds that the state patents issued by the state governments are incorrect in form, but that in principle they rest on the authority of the associated governments and of the Reichstag. Excerpt from Two Aspects of the German Constitution: A Thesis But, while according to this Article the members of the Federal Council are representatives of the members states, Article 9 calls it their function to represent the views of their respective governments. Article 9 begins: Every mem ber of the Federal Council has the right to appear in the Imperial Diet (reichstag), and has to be heard there on his demand at any time to represent the views of his govern ment. And again in contrast with Article 9, the preamble to the Constitution of the North German Federation, which latter was the predecessor of the present German Empire, enumerates the nineteen North German princes and the sen ates of the three free cities, and declares that they make an eternal union. This preamble sounds as if the princes and the senates were the parties to the transaction, and are now the members of the union. The question arises now, How can we unite these seem ingly contradictory passages where in one of them the mem ber states, in another the governments of the states, and in a third the sovereigns of the states seem to be considered the members of the empire? My standpoint-is this. It is impossible to deny that Article 6 calls the member states the members of the empire. But Prof. Laband is right in saying that the princes are the legitimate representatives of their respective states, and that they therefore together with the three senates may be considered the members of the empire and it is in this sense that the preamble to the Constitution of the North German Federation treats the princes and senates as the members of the empire. And finally it means the same thing whether one says either that the allied princes and sen ates, or that the allied governments are the members of the empire, and that for the reason that the term allied govern ments is so wide that it is applicable to the executives of all the German member states, of the twenty-two monarchies among them as well as of the three republics, and of the absolute monarchies as well as of the constitutional ones. This part of my explanation would reconcile the preamble to Article 9. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Excerpt from A Sketch of the German Constitution and of the Events in Germany: From 1815 to 1871 In placing before the public this sketch of the Constitution of the German Empire, I by no means lay claim to having clone adequate justice to so important a subject. My object has been merely to give English readers some idea of how a country, holding so prominent a position in Europe, is governed. Germany now occupies so much the attention of public men in all countries, that I thought a short explanation of the form of its Constitution might be acceptable to those who have neither the leisure nor the inclination to wade through the elaborate works which German writers have published on the subject. Excerpt from The New German Constitution It is a pleasure to introduce M. Brunet to the American public. He is a French scholar of the finest type, careful, objective, and sincere. The present work on the German constitution bears the impress of these high qualities. In this volume we find the scientific spirit that was to be expected, combined with an intimate, first-hand knowledge of the forces and materials which are described. All this is very significant. The long night of the Great War was hardly over before M. Brunet began an impartial and thorough-going study of the state of affairs created in Germany by the revolution of November, 1918. If a Frenchman who suffered so much can display such good sense and sobriety, then surely American scholars ought to give more than a hearty welcome to this volume. It is an excellent beginning in the reconstruction of the republic of letters. In this book we have a plain and simple account of the German revolution and the conflict of forces which ended in the establishment of the republic. The balance of parties is examined. The results of the elections to the national assembly are summarized. Then follows a systematic analysis of the new plan of government, illuminated by continual reference to the concrete historical circumstances in which the makers of the German constitution had to operate. M. Brunet has tried to steer his way on an even keel between the highly theoretical methods of the German political philosophers and the hard, matter-of-fact methods of the Anglo-Saxons. He has succeeded admirably. Accordingly, the usefulness of his volume extends beyond the information which it presents.
