The creation of the Ministry of Justice made significant changes to the Lord Chancellor's responsibilities, which may affect, in practice or public perception, the core responsibility of being the guardian of judicial independence. This report looks at the way these changes were made and finds the Government underestimated the significance of the changes it announced. The lack of sufficient consultation led to a public conflict between the senior judiciary and the previous Lord Chancellor, which could have been avoided if the lessons from the way changes to the Lord Chancellor's office were announced and effected between 2003 and 2005 had been learnt.

This book is a detailed examination of whether domestic security measures are striking an appropriate balance between homeland security and civil liberties in the post-9/11 era. Professor Paul Wilkinson and the other contributors assess the nature of UK responses to terrorism by key public and private-sector bodies, highlighting how these organizations can prevent, pre-empt, counter and manage terrorist attacks by using a matrix of factors such as types of terrorist networks, tactics and targets. The volume also compares and contrasts the UK's response with cognate states elsewhere in the EU and with the USA. While improved intelligence has helped prevent a major Al Qaeda attack, the authors conclude that there is still a ‘major question mark’ over whether the country is adequately resourced to deal with an emergency situation, particularly in major cities other than London. The book also confirms that while the UK faces a ‘real and serious’ threat of terrorist attack by Al Qaeda, it is better prepared for an attack than other EU member states. In the five years since the Ministry of Justice was created, it has made improvements to its structure and performance and is now a more integrated Department. However, the Ministry is still too much in thrall to the prison service: better integrated offender management would enable the Ministry to make the financial savings demanded of it but also provide a more effective service to clients, users and the wider public, and in particular to achieve its key objective to reduce re-offending. The Ministry has been subject to past criticism for poor financial management - missing the Treasury's deadline for the laying of accounts three years running, woeful inefficiency in the administration of legal aid and too much focus on policy at the expense of delivery. Following an in-depth investigation into all aspects of the Department's work, the Committee concluded that the Ministry has got a grip of the situation and is justifying the rationale for its creation. However, the MPs believe the Department could undergo further restructuring to create a single delivery body. Additionally, the current structure of the National Offender Management Service (NOMS), which continues to be driven by prison priorities, produces difficulties in reducing re-offending. The Committee also makes a number of further recommendations to improve how the Department functions

Narratives or storytelling are a feature of the everyday life of all who work in government. They tell each other stories about the origins, aims and effects of policies to make sense of their world. These stories form the collective memory of a government department; a retelling of yesterday to make sense of today. This book examines policies through the eyes of the practitioners, both top-down and bottom-up; it decentres policies and policymaking. To decentre is to unpack practices as the contingent beliefs and actions of individuals. Decentred analysis produces detailed studies of people’s beliefs and practices. It challenges the idea that inexorable or impersonal forces drive politics, focusing instead on the relevant meanings, the beliefs and preferences of the people involved. This book presents ten case studies, covering penal policy, zero-carbon homes, parliamentary scrutiny, children’s rights, obesity, pension reform, public service reform, evidence-based policing, and local economic knowledge. It introduces a different angle of vision on the policy process; it looks at it through the eyes of individual actors, not institutions. In other words, it looks at policies from the other end of the telescope. It concludes there is much to learn from a decentred approach. It delivers edification because it offers a novel alliance of interpretive theory with an ethnographic toolkit to explore policy and policymaking from the bottom-up. Written by members of the Department of Politics and International Relations of the University of Southampton, with their collaborators at other universities, the book’s decentred approach provides an alternative to the dominant evidence–based policy nostrums of the day.
