Excerpt from The Paradox of Oxford It is commonly agreed that no other city in Great Britain lays so potent a spell on the visitor as Oxford. The gardens of the sister university along the Cam may catch the charm of an English summer more entrancingly; Edinburgh, with her crown of hills, and her cavernous wynds, may be more picturesque; London, with her pride of empire, her spoils of art, her web of human triumphs and despair, may be more appalling to the imagination; but there is something in the aspect of the crowded, cloistered colleges of Oxford that penetrates more deeply into the mind of the observer and leaves him not quite the same man as before. Such at least was my experience last summer when I visited the town for the first time. "There is an air about it resonant of joy and hope: it speaks with a thousand tongues to the heart; it waves its mighty shadow over the imagination: ...its streets are paved with the names of learning that can never wear out: its green quadrangles breathe the silence of thought, conscious of the weight of yearnings innumerable after the past, of loftiest aspirations for the future." It was this feeling of the intellectual hopes and moral ideas of many generations of men here made visible in stone, rather than what has been called the "almost despairing sense of loveliness," that stirred me profoundly as I walked from court to court in the expressive silence of the long vacation. It was a feeling good and salutary for the heart. Yet in the end the impression left upon me was curiously mixed. I was elated and teased at the same time; my spirits were, so to speak, both enlarged and contracted. In part this was due, no doubt, to the manifest incongruities of the town itself as it has developed in these latter years. Excerpt from The Paradox of Tragedy: The Mahlon Powell Lectures, 1959 My subject is philosophy, not literary criticism, and the topics raised are dealt with as philosophical questions. My knowledge of drama is somewhat limited, and I am con scious that my appreciation of it may be biased in some respects by the strong impression made upon me in my youth by the Greek dramatists. Even of them I do not write as a classical scholar, but at least I have read most of the plays. With later drama, however, it is a very dif ferent story, and I can well believe that a more extensive and more detailed knowledge would require qualification of my views. My illustrations from post-hellenic drama are pretty well confined to works written in English or French. Such acquaintance as I have with parts of French literature is largely due to my wife, and these essays owe much to her. When using passages from Greek prose or verse, or from French prose, I have thought it best to borrow or give an English translation and, so far as practicable, to dispense with quoting the original language, though I regret the inevitable loss of beauty - in Anouilh as well as in Sophocles. When William Chafe's The American Woman was published in 1972, it was hailed as a breakthrough in the study of women in this century. Bella Abzug praised it as "a remarkable job of historical research," and Alice Kessler-Harris called it "an extraordinarily useful synthesis of material about 20th-century women." But much has happened in the last two decades--both in terms of scholarship, and in the lives of American women. With The Paradox of Change, Chafe builds on his classic work, taking full account of the events and scholarship of the last fifteen years, as he extends his analysis into the 1990s with the rise of feminism and the New Right. Chafe conveys all the subtleties of women's paradoxical position in the United States today, showing how women have gradually entered more fully into economic and political life, but without attaining complete social equality or economic justice. Despite the gains achieved by feminist activists during the 1970s and 1980s, the tensions continued to abound between public and private roles, and the gap separating ideals of equal opportunity from the reality of economic discrimination widened. Women may have gained some new rights in the last two decades, but the feminization of poverty has also soared, with women constituting 70% of the adult poor. Moreover, a resurgence of conservatism, symbolized by the triumph of Phyllis Schlafly's anti-ERA coalition, has cast in doubt even some of the new rights of women, such as reproductive freedom. Chafe captures these complexities and contradictions with a lively combination of representative anecdotes and archival research, all backed up by statistical studies. As in The American Woman, Chafe once again examines "woman's place" throughout the 20th century, but now with a more nuanced and inclusive approach. This title offers a unique approach to constitutionalism, focusing on the paradoxical relationship between principles and rules from the perspective of systems theory. It presents a critical counterpoint to Ronald Dworkin's principle-based theory, and in particular to Robert Alexy's idea of optimizing balancing. Instead of ceding to the compulsion of an optimizing balancing, it suggests the possibility of a comparative or at least 'satisficing' balancing, considering the precariousness of legal rationality. The book also reverses Dworkin's metaphor, associating rules with Hercules and principles with the Hydra. It takes constitutional principles seriously, criticizing the abuse of principles by the legal and constitutional doctrine and practice, and pointing out their relationship of complementarity and tension with rules. Finally, it offers an alternative model to the recent legal and constitutional theory on the basis of certain assumptions of the systems theory. It deals especially with the paradox of the circular and reflexive relationship between constitutional principles and rules: the former refers primarily to the openness and adequacy of legal system to society and thus to substantive argumentation; the second refers primarily to the closure and consistency of legal system and thus to formal argumentation.

This book focuses on death as life’s paradox in order to test, to put on trial, what it means for us human beings to exist. No one of us chooses to be born. Yet, having been born, we must choose to have been born, to live, to exist. To exist is to choose to exist. To choose to exist is to live with our choices. This text argues that death is the limit of life, that we can live freely and lovingly, at once justly and compassionately, solely within the limit of death. It shows that we can develop a comprehensive conception of life, and also of death, solely insofar as we learn to overcome the dualistic opposition between philosophy and theology that continues today to falsify our understanding of not only the secular, but also the sacred.
