Ideological Conflict And The Rule Of Law In Contemporary China written by Samuli Seppänen and has been published by Cambridge University Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 2016-10-20 with Law categories.
This book studies ideological divisions within Chinese legal academia and their relationship to arguments about the rule of law. The book describes argumentative strategies used by Chinese legal scholars to legitimize and subvert China's state-sanctioned ideology. It also examines Chinese efforts to invent new, alternative rule of law conceptions. In addition to this descriptive project, the book advances a more general argument about the rule of law phenomenon, insisting that many arguments about the rule of law are better understood in terms of their intended and actual effects rather than as analytic propositions or descriptive statements. To illustrate this argument, the book demonstrates that various paradoxical, contradictory and otherwise implausible arguments about the rule of law play an important role in Chinese debates about the rule of law. Paradoxical statements about the rule of law, in particular, can be useful for an ideological project.

The topic of moral competence is generally neglected in the study of public management and policy, yet it is critical to any hope we might have for strengthening the quality of governance and professional practice. What does moral competence consist in? How is it developed and sustained? These questions are addressed in this book through close examination of selected practitioners in Asian countries making life-defining decisions in their work. The protagonists include a doctor in Singapore, a political activist in India, a mid-level bureaucrat in central Asia, a religious missionary in China, and a journalist in Cambodia—each struggling with ethical challenges that shed light on what it takes to act effectively and well in public life. Together they bear witness to the ideal of public service, exercising their personal gifts for the well-being of others and demonstrating that, even in difficult circumstances, the reflective practitioner can be a force for good.

After the Cold War, how did China become a global symbol of disregard for human rights, while the U.S. positioned itself as the chief exporter of the rule of law? Teemu Ruskola investigates globally circulating narratives about what law is and who has it, and shows how “legal Orientalism” developed into a distinctly American ideology of empire.

Although ‘power’ can appear a vague term, the dichotomy between haves and have-nots, the desire to gain autonomy, and the dire consequences of subjugation, are three issues that resound across the arts and social sciences. In this book, postgraduate students from the constituent disciplines use the freedom of their positions as early-career researchers to boldly explore power relations. From a legal perspective, papers are included geared towards human rights issues and violations. Further, the applied perspectives from business and education researchers consider how access to wealth and education, and to equal education, can and must be achieved. Then, interpreted through the perspectives of anthropological, sociological, and historical approaches, power has become a resonant issue among the creations of culture and human interaction(s). Finally, within the ‘soft’ sciences, the very same preoccupations, as they appear in creative expression, are examined within literature and music. Indeed, through the twenty-one articles chosen for inclusion in this collection, distinct in their disciplinary origins, approaches and foci, together the authors are emphasising the many similarities that exist among the arts and social sciences subjects. ‘Perspectives on Power: An Interdisciplinary Approach’ was conceived as a result of the quality and reception of papers presented at the 2008 Moving Forward Postgraduate Conference, held at the University of Aberdeen. The volume comprises twenty-one articles on the theme of ‘power’, carefully chosen by the editorial team from in excess of eighty presentations. These represent and tender a wide range of scholarly approaches to and within the arts and social sciences; the remit of Moving Forward. The collection is aimed at scholars and scholarly institutions within the United Kingdom in particular, but contains contributions from scholars across the globe. The collection should especially appeal to and inspire delegates visiting the Moving Forward Postgraduate Conference in the years to come.

In the world, the home and the state prove themselves and change as basic institutions of human coexistence. They are the subject of a comparative study on an ecotheoretical basis. In the global context, the modes of social control have developed differently in the home and the state. In and with them, order is created in the world and for the individual and collective conduct of life. The institutional frameworks of house and state in the world are ways of shaping existence that are juxtaposed in their European-Occidental and East Asian forms: Their discussion takes place along the ancient Greek basic concepts and forms of thought of the oikos, the polis and the cosmos on the one hand and the ancient Chinese categories jia, guo and tianxia on the other. They are discussed with their ethical, political and economic references in their traditional and contemporary meaning and with regard to their ecological sustainability. The interest in a discursive understanding of sustainable, life-serving orders in the face of global challenges is the guiding principle

Law And Social Policy In The Global South written by Ulrike Davy and has been published by Taylor & Francis this book supported file pdf, txt, epub, kindle and other format this book has been release on 2022-12-13 with Law categories.
The book is an in-depth study of the origins and the trajectories of the law governing social policies in Brazil, China, India, and South Africa, four middle-income countries in the global South with a history in social policy making that starts in the 1920s. The policies of these countries affect almost half of the world’s population. The book takes the legal framework of the policies as a starting point, but the main interest lies behind the letter of the law: What were the objectives and goals of social policy over the course of the last 100 years? What were the ideas, ideologies, and values pursued by relevant actors? The book comprises four country studies and a comparative study. The country studies concentrate on the political and social context of social policy making in Brazil, China, India, and South Africa as well as on the ideas, ideologies, and values underpinning the constitution, statutory laws, and case law that frame and shape social policy at the national level. The country studies are complemented by a comparative study exploring and describing the commonalities and differences in the ideational approaches to social policies across the four countries, nationally and – in the formative decades – internationally. The comparative study also identifies the characteristics that make Brazilian, Chinese, Indian, and South African social policies distinct from European social policies. With its emphasis on law and drawing on legal scholarship, the book adds a new dimension to the existing accounts on welfare state building, which, so far, are dominated by European narratives and by scholars with a background in sociology, political science, and development studies. This book is relevant to specialists and peers and will be invaluable to those individuals interested in the fields of comparative and international social security law, human rights law, comparative constitutional law, constitutional history, law and development studies, comparative social policies, global social policies, social work, and welfare state theory.
