A violent fire was raging a few steps from his home, and when he was last seen he was endeavoring to assist the tenant of a shop on the lower floor of the burning building to remove a portion of his goods. Immediately afterwards the rafters fell in, and when, in a few hours, the ruins were cleared away, the memorials that remained were enough only to justify the belief that his death must have been as instant as it was unwarned. He was a man of excellent professional acquire ments, of kindly manners, and of an open and genial temper, which never failed him in life, and which threw around his last melancholy hour a grace which will print his memory the more deeply in the breasts not only of his professional brethren, but of the hundreds who have drawn and may yet draw from this work their first acquaintance with the practice of the Pennsylvania Law. Perhaps the best monument that could be erected to his memory is the volumes which his first labors aided to construct, and his last efforts retouched. Excerpt from The Practice in Civil Actions and Proceedings in the Supreme Court of Pennsylvania, Vol. 1 of 2: In the Courts of Common Pleas for the County of Philadelphia and in the Courts of the United States This work, originally prepared by francis J. Troubat and wil liam W. Haly, two distinguished and learned members Of the Phila delphia Bar, was presented to the Profession in the year 1825, in one thin octave volume; a second volume appeared in 1829. It immedi ately took high rank as a professional text-book; and probably no gentleman has since been admitted to our Bar, who has not drawn from its pages his first knowledge Of the intricacies of Practice. In 1837, the same learned gentlemen favored the profession with a second edition, in two volumes. Shortly after the publication of this edition, Mr. Troubat retired from active practice, and Mr. Haly, at the time of his sudden and fearful death, on the 27th of December 1851, in the destructive fire, at Sixth and Chestnut streets, in the City of Phila delphia, had made great progress in the preparation of a third edition. The materials collected by Mr. Haly were placed in the hands of Dr. Francis wharton, the well-known legal writer, and by him the third edition was prepared for the press. This edition was enriched by the insertion of the manuscript notes of decisions of the present Chief Justice sharswood, then President Judge Of the District Court of Philadelphia. These valuable cases have been retained in the present edition, with the exception of a small number, which have been subsequently overruled, or rendered obsolete by legislation. Dr. Wharton'8 edition was published in 1853. The fourth edition, which appeared in the year 1867, was edited by the late asa I. Fish, Esq. The Trials of Allegiance examines the law of treason during the American Revolution: a convulsive, violent civil war in which nearly everyone could be considered a traitor, either to Great Britain or to America. Drawing from extensive archival research in Pennsylvania, one of the main centers of the revolution, Carlton Larson provides the most comprehensive analysis yet of the treason prosecutions brought by Americans against British adherents: through committees of safety, military tribunals, and ordinary criminal trials. Although popular rhetoric against traitors was pervasive in Pennsylvania, jurors consistently viewed treason defendants not as incorrigibly evil, but as fellow Americans who had made a political mistake. This book explains the repeated and violently controversial pattern of acquittals. Juries were carefully selected in ways that benefited the defendants, and jurors refused to accept the death penalty as an appropriate punishment for treason. The American Revolution, unlike many others, would not be enforced with the gallows. More broadly, Larson explores how the Revolution's treason trials shaped American national identity and perceptions of national allegiance. He concludes with the adoption of the Treason Clause of the United States Constitution, which was immediately put to use in the early 1790s in response to the Whiskey Rebellion and Fries's Rebellion. Though originally an interloper in a system of justice mediated by courtroom battles, plea bargaining now dominates American criminal justice. This book traces the evolution of plea bargaining from its beginnings in the early nineteenth century to its present pervasive role. Through the first three quarters of the nineteenth century, judges showed far less enthusiasm for plea bargaining than did prosecutors. After all, plea bargaining did not assure judges “victory”; judges did not suffer under the workload that prosecutors faced; and judges had principled objections to dickering for justice and to sharing sentencing authority with prosecutors. The revolution in tort law, however, brought on a flood of complex civil cases, which persuaded judges of the wisdom of efficient settlement of criminal cases. Having secured the patronage of both prosecutors and judges, plea bargaining quickly grew to be the dominant institution of American criminal procedure. Indeed, it is difficult to name a single innovation in criminal procedure during the last 150 years that has been incompatible with plea bargaining’s progress and survived.
