Penitential practice in the Holy Roman Empire 900-1050, examined through records in church law, the liturgy, monastic and other sources. This study examines all forms of penitential practice in the Holy Roman Empire under the Ottonian and Salian Reich, c.900 - c.1050. This crucial period in the history of penance, falling between the Carolingians' codification of public and private penance, and the promotion of the practice of confession in the thirteenth century, has largely been ignored by historians. Tracing the varieties of penitential practice recorded in church law, the liturgy, monastic practice, narrative and documentary sources, Dr Hamilton's book argues that many of the changes previously attributed to the twelfth and thirteenth centuries can be found earlier in the tenth and early eleventh centuries. Whilst acknowledging that there was a degree of continuity from the Carolingian period, she asserts that the period should be seen as having its own dynamic. Investigating the sources for penitential practice by genre, sheacknowledges the prescriptive bias of many of them and points ways around the problem in order to establish the reality of practice in this area at this time. This book thus studies the Church in action in the tenth and eleventh centuries, the reality of relations between churchmen, and between churchmen and the laity, as well as the nature of clerical aspirations. It examines the legacy left by the Carolingian reformers and contributes to our understanding of pre-Gregorian mentalities in the period before the late eleventh-century reforms. This study of Burchard's 'Decretum', a popular book of Catholic canon law compiled just after the year 1000, sheds new light on the development of law and theology long before the Gregorian Reform, normally considered as a watershed in the history of the Latin Church. Practical episcopal concerns and an appreciation of new scholarly methods led Burchard to be dissatisfied with the quality of contemporary jurisprudence and particularly with the teaching texts available to local bishops. Drawing upon new manuscript discoveries, the author shows how Burchard tried to create a new text that would address these problems. He carefully selected and compiled canons from earlier collections and then went on to tamper systematically with the texts he had chosen. By doing so, he created a book of church law that appeared to be based on indisputable authority, that was internally consistent and that was easy to apply through logical extrapolation to new cases. The present study thus provides a window into the development of legal and theological reasoning in the medieval West, and suggests that, thanks to the work of ambitious bishops, the flowering of law and theology began far earlier, and for different reasons, than scholars have heretofore supposed.

Excommunication was the medieval churchâs most severe sanction, used against people at all levels of society. It was a spiritual, social, and legal penalty. Excommunication in Thirteenth-Century England offers a fresh perspective on medieval excommunication by taking a multi-dimensional approach to discussion of the sanction. Using England as a case study, Felicity Hill analyzes the intentions behind excommunication; how it was perceived and received, at both national and local level; the effects it had upon individuals and society. The study is structured thematically to argue that our understanding of excommunication should be shaped by how it was received within the community as well as the intentions of canon law and clerics. Challenging past assumptions about the inefficacy of excommunication, Hill argues that the sanction remained a useful weapon for the clerical elite: bringing into dialogue a wide range of source material allows âeffectivenessâ to be judged within a broader context. The complexity of political communication and action are revealed through public, conflicting, accepted and rejected excommunications. Excommunication could be manipulated to great effect in political conflicts and was an important means by which political events were communicated down the social strata of medieval society. Through its exploration of excommunication, the book reveals much about medieval cursing, pastoral care, fears about the afterlife, social ostracism, shame and reputation, and mass communication.
