The challenge is that he shall search his own consciousness to its depths and bring back its report. I have tried to tell merely what my consciousness assures me. The question for the reader is: What does your consciousness, honestly and thoroughly questioned, reply to these statements I only venture to offer them as a means for bringing the study home to other minds. If this essay seems to be fragmentary the material for a philosophy of ethics and religion, rather than the completed thought I may, perhaps, be allowed to refer my readers to The Theology of Civilization, in which I have endeavored more fully to relate together the results of this study into their proper unity. If there is further wish to know the practical outcome of this sort of study; if any one asks the chief of all vital questions, namely, What is the test and working value of this view of the Problem of Duty possibly the reader may be willing to find my answer in The Coming People, where I have tried to express in the simplest terms an interpretation of life, which seems to me to be a perennial inspiration toward noble conduct and reverent faith. Most people have wondered whether anything really matters, some have temporarily thought that nothing really matters, and some philosophers have defended the view that nothing really matters. However, if someone thinks that nothing matters--if they are a "nihilist about value"--then it seems that it is irrational for them to care about anything. It seems that nihilism about value mandates total indifference. This is the "problem of nihilism" Allan Hazlett addresses in The Epistemology of Desire and the Problem of Nihilism. Hazlett argues that the problem of nihilism arises because desire--and thus caring--is a species of evaluation that admits of irrationality. This contradicts the influential Humean view that desire does not admit of irrationality, which has a ready solution to the problem of nihilism: since desire does not admit of irrationality, it cannot be irrational to care about something that you believe does not matter. However, following G.E. Anscombe, Hazlett argues that desire has the same relationship to goodness as belief has to truth: just as truth is the accuracy condition for belief, goodness is the accuracy condition for desire. This reveals desire as an appropriate target of epistemological inquiry, in the same way that belief is an appropriate target of epistemological inquiry. Desires can amount to knowledge (in the same way that beliefs can amount to knowledge) and, crucially for the problem of nihilism, desire admits of irrationality (in the same way that belief admits of irrationality). Nevertheless, although it is obviously irrational to believe something that you believe is not true, Hazlett argues that it is not irrational to desire something you believe is not good, despite the fact that goodness is the accuracy condition for desire. This provides a solution to the problem of nihilism, and shows that nihilism about value can coherently be combined with the anti-Humean view that desire is a species of evaluation.

A woman terrified by the threats of a jilted suitor is denied police protection. A workman collapses on the job and the employer is slow to help him. A bully in a bar begins to carry out threats of serious injury to a customer, after the bartender’s lackadaisical response. Springing from varied areas of human activity, such cases occupy an important area of the legal battleground called modern tort law. They also provide the basis for a fascinating legal analysis by Marshall S. Shapo. Tort law is an important social mediator of events surrounding personal injuries. It impinges on many other areas of the law—those dealing with crime, constitutional protections against government officials and agencies, and property rights. Since litigated tort cases often involve brutal treatment or accidents inflicting severe physical harm, this area of the law generates much emotion and complex legal doctrine. Shapo cuts through the emotion and the complexity to present a view of these problems that is both legally sound and intuitively appealing. His emphasis is on power relationships between private citizens and other individuals, as well as between private persons and governments and officials. He undertakes to define power in a meaningful way as it relates to many tort issues faced by ordinary citizens, and to make this definition precise by constant reference to concrete cases. His particular focus is on an age-old problem in tort law: the question of when a person has a duty to aid another in peril. In analyzing a large number of cases in this category, Shapo develops an analysis that blends considerations of economic efficiency and humanitarian concern. Recognizing that economic considerations are significant in judicial analysis of these cases, he emphasizes elements that go beyond a simple concern with efficiency, especially the ability of one person to control another’s actions or exposure to risk. These considerations of power and corresponding dependence provide the basis for Shapo’s study of the duties of both private citizens and governments to prevent injury to others. Calling on a broad range of legal precedents, he also refers to social science research dealing with the behavior of bystanders when fellow citizens are under attack. Beyond his application of a power-based analysis to litigation traditionally based in tort doctrine, Shapo offers some speculative suggestions on the possible applicability of his views to several controversial areas of welfare law: medical care, municipal services, and educational standards. This book was written with a view to readership by interested citizens as well as legal scholars, judges, and practicing attorneys.
