The public responsibility for higher education and research is a cornerstone of the European university heritage. Yet, our societies are changing rapidly, and clinging to old solutions will not further the very values that these solutions were originally designed to protect. The claim on public attention and public funds is growing, but public funds are not, or at least not at the same rate. While public funding of higher education and research is still important, the concept of public responsibility must be understood much more widely. It must also be nuanced by looking more closely at different degrees and levels of public responsibility as well as at the instruments available for exercising such responsibility. The book, which builds on a Council of Europe conference, aims to explore what public responsibility means in the complex societies that have just crossed the threshold to the 21st century by examining both overall higher education policies and specific aspects of it such as higher education for a democratic culture, access to research results, financing, equal opportunities, the approach to regulation and new trends in higher education.

Universities have never been static. Even so, it is fair to say they have experienced a most radical transformation in the past twenty years. During this period, the role and responsibility of the state generally have been broadly limited while allowing ‘market forces’--private ownership and control--more influence. But even where the state is still the main provider or funder, it relies increasingly on ‘market mechanisms’, for example contractual relations between state and institutions, competition among providers for resources, and external assessment of ‘outputs’ which means the results or impact of what universities do, in particular teaching and research. The new terminology speaks of price and competition, inputs and outputs, resources, cost and benefits, demand and supply, provider and customer, consumers and investors, quality control and accountability. Education, and post-secondary education especially are increasingly seen as matters for markets. Formal post-secondary education becomes a service, commercialized and traded across national borders. This volume on changing relationship between state and market, contains, besides an introductory analytic overview of the issues, accounts from different countries, regions, and thematic perspectives. Chapter authors describe and analyze government reforms and other developments that have directly or indirectly affected this relationship. Although the geographical focus is on North America, especially Mexico, South East Asia and Europe, the phenomenon is not limited to these regions and countries but worldwide.

Higher education is too often dissociated from the right to education. In many countries tuition fees are on the rise, and only the privileged have access to, or succeed in completing, higher education, making it difficult to argue that there is an actual right to higher education to be enforced. However, international human rights law is clear: the right to education includes the obligation of states to ensure that higher education is made accessible to all based on capacity. In addition, states have an obligation to progressively introduce free higher education, an obligation which is yet to be implemented globally. Confronted with drastic changes worldwide interms of rising inequalities, human movement, growing digitalization and the effects ofthe COVID-19 pandemic, it is high timeto clarify existing obligations as wellas what aspects of the right to higher education might require further explanation considering new contexts and challenges. This publication aims to help guide policy-makers, civil society and the international education community, to fully enforce the right to higher education and ensure that the human-rights based approach is placed at the heartof the higher education debate.

Academic freedom and institutional autonomy are essential for universities to produce the research and teaching necessary to improve society and the human condition. Academic freedom and institutional autonomy are increasingly important components of the development of democracy. At the same time, these fundamental democratic values are subject to pressure in many countries. The relationship between academic freedom, institutional autonomy and democracy is fundamental: it is barely conceivable that they could exist in a society not based on democratic principles, and democracy is enriched when higher education institutions operate on this basis. Higher education institutions need to be imbued with democratic culture and that, in turn, helps to promote democratic values in the wider society.
