During the last half of the twentieth century, legal philosophy (or legal theory or jurisprudence) has grown significantly. It is no longer the domain of a few isolated scholars in law and philosophy. Hundreds of scholars from diverse fields attend international meetings on the subject. In some universities, large lecture courses of five hundred students or more study it. The primary aim of the Law and Philosophy Library is to present some of the best original work on legal philosophy from both the Anglo-American and European traditions. Not only does it help make some of the best work avail able to an international audience, but it also encourages increased awareness of, and interaction between, the two major traditions. The primary focus is on full-length scholarly monographs, although some edited volumes of original papers are also included. The Library editors are assisted by an Editorial Advisory Board of internationally renowned scholars. Legal philosophy should not be considered a narrowly circumscribed field. Insights into law and legal institutions can come from diverse disciplines on a wide range of topics. Among the relevant disciplines or perspectives con tributing to legal philosophy, besides law and philosophy, are anthropology, economics, political science, and sociology. Among the topics included in legal philosophy are theories of law; the concepts of law and legal institutions; legal reasoning and adjudication; epistemological issues of evidence and pro cedure; law and justice, economics, politics, or morality; legal ethics; and theories oflegal fields such as criminal law, contracts, and property.

In accordance with our general definition of the rational we shall expect the rational good in the first place to be consistent throughout. That is to say, whatever is reasonably held good must not tend to clash with anything else that is reasonably held good. Just as two rational judgments must not contradict one another, so two rational purposes must not conflict with one another, and if two kinds of experience, both apparently good, are found to conflict, it becomes necessary to seek some means of reconciling the contradiction. Of the problem thus set to the practical reason we shall speak presently. But let us observe now in the second place that negative consistency is not enough. Whether we think of the judgment "This is Good" as an assertion or as theexpression of an impulse-feeling it must, to be rational, have a ground, and the ground must be universal. The end or act or feeling that is good as such must be good wherever and in whomsoever found, and that which is good under given conditions must be good wherever these conditions obtain. But further, if we have to find grounds for these universals--grounds for our grounds--we shall be pushed along the same line of criticism as before in dealing with cognition. Principles that figure as immediate and self-evident will be seen themselves to require a ground,1 and the ground which If it has to be admitted on the theoretic side that acceptance of first principles as self-evident is dependent on our mental constitution, it is much more easily seen on the practical side that 78 will be found if they are valid is the fact that they sum upandgeneralize more specific...

Modern logic has Wldergone some remarkable developments in the last hun dred years. These have contributed to the extraordinary use of formal logic which has become essentially the concern of mathematicians. This has led to attempts to identify logic with formal logic. The claim has even been made that all non-formal reasoning, to the extent that it cannot be formalized, no longer belongs to logic. This conception leads to a genuine impoverishment of logic as well as to a narrow conception of reason. It means that as soon as demonstrative proofs are no longer available reason will no longer dominate. Even the idea of the 'reasonable' becomes foreign to logic and such expres sions as 'reasonable decisions', 'reasonable choice' or 'reasonable hypotheses' would be put aside as meaningless. The domain of action, including method ology and everything that is given over to deliberation or controversy - i.e., foreign to formal logic - would become a battleground where necessarily the reason of the strongest would always prevail.
