Law is the great concealer; and law is everywhere. Or so claimed Marxists once upon a time. [Law] was imbricated within the mode of production and productive relations themselves . . . it intruded brusquely within alien categories, re-appearing bewigged and gowned in the form of ideology; . . . it was an arm of politics and politics was one of its arms; it was an academic discipline, subjected to the rigour of its own autonomous logic, it contributed to the definition of the self-identity of both the rulers 1 and the ruled. Does the old critique of domination still hold any sway? Apparently not. Or so even scholars of the far Left keep reminding us in their eagerness to embrace law and proclaim their allegiance to the new constitutional politics of civil society. Old Marxists now describe popular sovereignty as 'co-original' with, and democracy 'internally linked' to 2 constitutional rights and find it hard to remember what it was they once disagreed with liberals about. No tension left between emancipatory politics and oppressive law; instead we have reciprocal constitution, simultaneous realisation. In the Left's embracing of the new constitutionalisms its old critique of law - the critique of the law's concealment of class inequality, class conflict and class action - is left behind.

Combining phenomenological insights from Brentano and Sartre, but also drawing on recent work on consciousness by analytic philosophers, this book defends the view that conscious states are reflexive, and necessarily so, i.e., that they have a built-in, “implicit” awareness of their own occurrence, such that the subject of a conscious state has an immediate, non-objectual acquaintance with it. As part of this investigation, the book also explores the relationship between reflexivity and the phenomenal, or “what-it-is-like,” dimension of conscious experience, defending the innovative thesis that phenomenal character is constituted by the implicit self-awareness built into every conscious state. This account stands in marked contrast to most influential extant theories of phenomenal character, including qualia theories, according to which phenomenal character is a matter of having phenomenal sensations, and representationalism, according to which phenomenal character is constituted by representational content. Self-reference, although a topic studied by some philosophers and known to a number of other disciplines, has received comparatively little explicit attention. For the most part the focus of studies of self-reference has been on its logical and linguistic aspects, with perhaps disproportionate emphasis placed on the reflexive paradoxes. The eight-volume Macmillan Encyclopedia of Philosophy, for example, does not contain a single entry in its index under "self-reference", and in connection with "reflexivity" mentions only "relations", "classes", and "sets". Yet, in this volume, the introductory essay identifies some 75 varieties and occurrences of self-reference in a wide range of disciplines, and the bibliography contains more than 1,200 citations to English language works about reflexivity. The contributed papers investigate a number of forms and applications of self-reference, and examine some of the challenges posed by its difficult temperament. The editors hope that readers of this volume will gain a richer sense of the sti11largely unexplored frontiers of reflexivity, and of the indispensability of reflexive concepts and methods to foundational inquiries in philosophy, logic, language, and into the freedom, personality and intelligence of persons.
