The 1944 Bretton Woods conference created new institutions for international economic governance. Though flawed, the system led to a golden age in postwar reconstruction, sustained economic growth, job creation, and postcolonial development. Yet financial liberalization since the 1970s has involved deregulation and globalization, which have exacerbated instability, rather than sustained growth. In addition, the failure of Bretton Woods to provide a reserve currency enabled the dollar to fill the void, which has contributed to periodic, massive U.S. trade deficits. Our latest global financial crisis, in which all these weaknesses played a part, underscores how urgently we must reform the international financial system. Prepared for the G24 research program, a consortium of developing countries focused on financial issues, this volume argues that such reforms must be developmental. Chapters review historical trends in global liquidity, financial flows to emerging markets, and the food crisis, identifying the systemic flaws that contributed to the recent downturn. They challenge the effectiveness of recent policy and suggest criteria for regulatory reform, keeping in mind the different circumstances, capacities, and capabilities of various economies. Essays follow ongoing revisions in international banking standards, the improved management of international capital flows, the critical role of the World Trade Organization in liberalizing and globalizing financial services, and the need for international tax cooperation. The book assesses emerging powers’ influence on international economic law and analyses whether their rhetoric of reforming this ‘unjust’ order translates into concrete reforms. The questions at the heart of the book surround the extent to which Brazil, Russia, India, China, and South Africa individually and as a bloc (BRICS) provide alternative regulatory ideas to those of ‘Western’ States and whether they are able to convert their increased power into influence on global regulation. To do so, the book investigates two broader case studies, namely, the reform of international investment agreements and WTO reform negotiations since the start of the Doha Development Round. As a general outcome, it finds that emerging powers do not radically challenge established law. ‘Third World’ rhetoric mostly does not translate into practice and rather serves to veil economic interests. Still, emerging powers provide for some alternative regulatory ideas, already leading to a diversification of international economic law. As a general rule, they tend to support norms that allow host States much policy space which could be used to protect and fulfil socio-economic human rights, especially – but not only – in the Global South.

State re-scaling is the central concept mobilized in this book to interpret the political processes that are producing new economic spaces in India. In the quarter century since economic reforms were introduced, the Indian economy has experienced strong growth accompanied by extensive sectoral and spatial restructuring. This book argues that in this reformed institutional context, where both state spaces and economic geographies are being rescaled, subnational states play an increasingly critical role in coordinating socioeconomic activities. The core thesis that the book defends is that the reform process has profoundly reconfigured the Indian state’s rapport with its territory at all spatial scales, and these processes of state spatial rescaling are crucial for comprehending emerging patterns of economic governance and growth. It demonstrates that the outcomes of India’s new policy regime are not only the product of impersonal market forces, but that they are also the result of endogenous political strategies, acting in conjunction with the territorial reorganisation of economic activities at various scales, ranging from local to global. Although necessary and often first rate, technocratic solutions alone have been ineffective in delivering real change or lasting results in governance reforms. This is primarily because reform programs are delivered no in controlled environments, but under complex, diverse, sociopolitical and economic conditions. Real-world conditions. In political societies, ownership of reform programs by the entire country cannot be assumed, public opinion will not necessarily be benign, and coalitions of support may be scare or nonexistent, even when intended reforms really will benefit those who need them most. While the development community has the technical tools to address governance challenges, experience shows that technical solutions are often insufficient. Difficulties arise when attempts are made to apply what are often excellent technical solutions. Human beings--either acting alone or in groups small and large--are not as amenable as are pure numbers, and they cannot be ignored. In the real world, reforms will not succeed, and they will certainly not be sustained, without the correct alignment of citizens, stakeholders, and voice. 'Governance Reform under Real-World Conditions: Citizens, Stakeholders, and Voice' is a contribution to efforts to improve governance systems around the world, particularly in developing countries. This book explores how international organizations (IOs) have expanded their powers over time without formally amending their founding treaties. IOs intervene in military, financial, economic, political, social, and cultural affairs, and increasingly take on roles not explicitly assigned to them by law. Sinclair contends that this 'mission creep' has allowed IOs to intervene internationally in a way that has allowed them to recast institutions within and interactions among states, societies, and peoples on a broadly Western, liberal model. Adopting a historical and interdisciplinary, socio-legal approach, Sinclair supports this claim through detailed investigations of historical episodes involving three very different organizations: the International Labour Organization in the interwar period; the United Nations in the two decades following the Second World War; and the World Bank from the 1950s through to the 1990s. The book draws on a wide range of original institutional and archival materials, bringing to light little-known aspects of each organization's activities, identifying continuities in the ideas and practices of international governance across the twentieth century, and speaking to a range of pressing theoretical questions in present-day international law and international relations.
