"At international law, the refugee definition enshrined in Article 1A(2) of the Refugee Convention and its 1967 Protocol remains central. Yet over 70 years on, the meaning of its key terms is still widely perceived to be unclear and uncertain. Siren voices continue to warn against any attempt at further definition. How long must we brook such a lack of clarity? That is this study's abiding question. In trying to answer this question, this study does three main things. It seeks to address several 'framework' questions concerned with approaches to definition, interpretation, ordering and to the interrelationship between the definition's different elements. Next, it analyses each element of the definition, applying Vienna Convention of the Law of Treaties (VCLT) rules in systematic fashion. In the process, it seeks to address the main interpretive positions that have been taken in UNHCHR, case law and academic materials regarding each element of the definition, evaluating their merits and demerits, and to propose solutions animated by a human rights approach. The third main thing this study does, which is seen as by far the most important, is to reflect on what propositions have been widely agreed and to try and assemble all of these in the one place so as to achieve a 'working definition'. The author seeks to argue that in fact there is much more agreement than many think about the meaning of key terms, that many of the main disagreements that have arisen have been resolved, and that it is now within our reach to concretise this working definition, the most practicable means being wholesale revision of the 1979 UNHCR Handbook"--

The essays selected and reproduced in this volume explore how international refugee law is dynamic and constantly evolving. From an instrument designed to protect mostly those civilians fleeing the worse excesses of World War II, the 1951 Refugee Convention has developed into a set of principles, customary rules, and values that are now firmly embedded in the human rights framework, and are applicable to a far broader range of refugees. In addition, international refugee law has been affected by international humanitarian law and international criminal law (and vice versa). This book considers the United Nations High Commissioner for Refugees’ contribution to international refugee law since the establishment of UNHCR by the United Nations General Assembly in 1951. The book explores the historical and statutory foundations that create an indelible link between UNHCR and international refugee law. This book charts the significant evolution that has occurred in the organisation’s role throughout the last sixty years, looking at both the formal means by which UNHCR’s mandate may be modified, and the techniques UNHCR has used to facilitate the changes in its role, thereby revealing a significant evolution in the organisation’s role since the onset of the crisis in refugee protection in the 1980’s. UNHCR, itself, has demonstrated its organizational autonomy as the primary agent for the adaptation of its responsibilities and work related to international refugee law. The author does suggest however that UNHCR needs to continue to extend and strengthen its role related to international refugee law if UNHCR is to ensure a stronger legal framework for the protection of refugees as well as a fuller respect for refugees’ rights in practice. The present volume highlights the new challenges of the international protection of refugees fifty years after the adoption of the 1951 Geneva Convention relating to the Status of Refugees. Focusing on the problems faced by Switzerland in the field of international protection of refugees as well as on the specificity of its asylum law and practice, this publication addresses the refugee problem from a national, European and international perspective. The Swiss experience serves to illustrate the wider problematic of on the one hand, the tensions between security, political and humanitarian concerns encountered by refugee-receiving states, and on the other, the need to preserve an international refugee protection regime which remains an essential component of international law and relations for so long as political solutions are not brought to the root causes of refugee exodus. This reflection on the international protection of refugees is organized around four main themes. The first examines Switzerland's response in the past to mass influx, in the light of historical case studies and the evolution of Swiss asylum law and practice. The second focuses on the question of access of refugees to asylum territories and refugee status determination procedures within the framework of the 1951 Convention on the Status of Refugees and the current Swiss asylum law. The third centres on the wider protection regime currently being forged in Europe to address a broader category of refugees, including solutions for temporary and subsidiary protection. The final theme revolves around return of refugees, including those under the Dayton and recent Kosovo agreements and covers reintegration of returnees, assistance and long-term development. This work is based on papers presented at a colloquium of the Graduate Institute of the International Studies in Geneva which was organised in collaboration with the Office of the United Nations High Commissioner for Refugees as a contribution to the 50th anniversaries of the UNHCR and the Geneva Convention relating to the Status of Refugees.
