This book considers how vulnerability theory provides the basis for a reconceptualization of the liberal ideas of autonomy, equality, and freedom. Vulnerability theory argues a “vulnerable legal subject” should displace the “liberal legal subject” that currently dominates law and policy. The theory is based on the fundamental empirical realities of the material body and offers an alternative to a social contract or rights-based notion of state responsibility, both of which tend to privilege abstractions such as rationality or dignity. A vulnerability analysis poses law and policy questions based on the “vulnerable legal subject” and requires new thinking about state or governmental responsibility. To achieve a truly comprehensive and inclusive notion of what constitutes social justice or a universal or common good, vulnerability theory mandates a reassessment of both equality and freedom as these concepts are currently conceived. Presenting the work of scholars from a wide range of doctrinal areas, it is this task that the book takes up. In particular, in recognizing that many social or institutional relationships entail uneven positions of dependence and reliance, it maintains that individualized notions of equality or freedom are inadequate and must be reformulated to include a sense of collective or social justice, incorporating asymmetric or unequal allocations of responsibility, and requiring appropriate limitations on the individual. This book’s reorientation of the subject, as well as the central objectives of law and policy, will appeal to scholars and students in law, vulnerability studies, gender studies, critical legal and political theory, politics, philosophy, and sociology.

Natural and Necessary Unions is a history for our time. It shows that the choice between 'union and independence' that shapes current debates about the future of the United Kingdom in the age of Brexit is a false one. Against the countervailing currents of hegemony and fragmentation that range across centuries - from the economic dominance of southern England and the burdens of social democracy to the rise of separatist nationalisms and European integration - unionists struggled to make a union-state that would protect the independence of its citizens and communities from these wider forces. Natural and Necessary Unions tells the story of how the quest for autonomy shaped the history of three communities: Scotland, Ireland, and Northumbria. How have EU-level actors responded to the increase in salience and contestation across the member states? This volume explores and explains the actors’ strategic responses and emphasises that domestic pressure has triggered both depoliticisation and politicisation. Long gone are the times when EU decisions left citizens indifferent, and when the supranational was largely irrelevant for public opinion and electoral politics across the member states. Instead, a string of existential crises has struck and unsettled the Union over more than a decade. These crises have politicised Europe, tested the endurance of the supranational system to its core, and put EU-level actors under unprecedented pressure. This volume explores how and why EU-level actors respond to the various, sometimes competing, ‘bottom-up’ demands, and challenges the view that domestic contestation necessarily limits EU-level room for manoeuvre. Instead, contributions show that domestic pressure can be perceived as either constraining or enabling, with responses, therefore, ranging from the restrained to the assertive. Driven by the survival of the Union, by the preservation of their own powers, and by different perceptions of domestic demands, actors will choose to politicise or depoliticise decision-making, behaviour, and policy outcomes at the supranational level. The volume concludes that whilst domestic pressure triggers supranational responses, such responses should not be assumed to be restraining; they may equally be empowering including for European integration itself. The chapters in this book were originally published as a special issue of the Journal of European Public Policy.

The European Union is facing today the greatest crisis since its creation. Brexit could mean not only the reversal of its steady enlargement—from 6 to 28 member states—but also the beginning of an inexorable decline leading to its disintegration. However, few today seem to recollect that it was precisely the British who were the first to promulgate the political culture which inspired the European Union’s construction—democracy and federalism—and the first who tried to realise, in June 1940, a European federation on the basis of an Anglo-French union. This volume traces the fundamental stages of the European unification process, placing it in relation to the wider process of world economic and political integration. In particular, it analyses the historical significance of the European Revolution, which is identified in the overcoming of the nation state—namely the modern political formula which institutionalised the political division of mankind—and the birth of the first truly international state. The universal historical significance of the European Revolution lies in its exportability—as for the other great European revolutions—and, therefore, its potential as progressively extensible to all the states of the planet. Europe was indeed the first region of the world where the barriers between national states fell, and a post-national political identity emerged, complementary to national political identities. It is, in fact, in the context of the European Union that democracy beyond the borders of the nation state has first been realized, constituting a guiding principle for global governance.
